BANGKOK: -- The National Legislative Assembly is scheduled to convene on December 25 to decide whether to impeach former prime minister Yingluck Shinawatra in connection with her government's rice-pledging scheme.

The NLA is expected to debate the issue and vote within three days of convening.

Support from at least three-fifths of the body's members, or 132 votes, is required to impeach the ex-premier. The vote will be done in a secret ballot.

The assembly will convene on December 11 to hear the opening statements from both Yingluck and the National Anti-Corruption Commission, with the closing statements to be heard on December 23, according to the NLA meeting schedule released yesterday.

No, this is about preventing her or anyone else for that matter from getting in the position where they can do the same again whether it be negligence as she is charged with, corruption or outright theft.

Does someone who has been caught with their hand in the till of a company still have to be employed by the company before they can be held responsible ?

So why should it be any different for a politician ?

I tell you it shouldn't, in fact there should be even higher standards for politicians who are supposed to be role models.

Stress 'supposed to be' but how many of the previous Govt's line up would you chose as roll models for your kids ?

So what do you get charged with for not allowing freedom of the press? or interfering in pending serious criminal charges? Or nepotism?

The fact of the matter is that rice schemes in the past have all lost money; But Ms Y lost the most. It would be interesting to see what the defence is?

The press can only print positive on the case, and cannot report on anyone that has an opinion other than the Government view.

Means she would be banned from politics for 5 years. The criminal prosecution is a separate matter which is currently bogged down with the attorney-general declining to take the case prepared by the NACC. The latter could prosecute by itself but that could involve a considerable delay and a lower chance of success. No one has yet suggested s civil case to recover the losses, as happened (unsuccessfully) in the case of the central bank governor who presided over massive losses in the futile defence of the baht in1997.

The concept of impeachment in Thailand differs from many other countries because of the political bans that can be imposed. That is why cases can be heard after the defendant has left office. There have been very few, if any, successful impeachments due to the supermajority required in the Senate. With a straight eviction from office and no political ban, many could be back in office the next day. After Samak was removed from office by the Constitutional Court he could have been reinstated by parliament immediately but Thaksin had had enough of him.

There remains potential criminal charges which would result in a lifetime ban if found guilty.

She would be banned from politics for 5 years and possibly criminal charges.

She will be given the ban, but it really ought to be for life, this Thai style of politics is totally laughable. It would allow someone to have been banned multiple times can still be a PM.

The criminal charges will not need to come from impeachment though, these charges can be actually implemented immediately. The NACC can petition the Supreme Court for Political Office Holders whenever they feel they have a case. But the NACC seem to be holding this back in reserve as an ace up their sleeve.

They have already threatened to invoke this if the NLA do not proceed with the impeachment vote.

Unfortunaltely since I have become aware that there are a bunch of Thaksin supporters on the NLA, I doubt very much that they will get the three fifths of the vote.... Looks like Thaksin has managed to infiltrate the entire system, and I would be very interested to know exactly how much influence he has managed to put into it.

So I can see it is going to be business as usual in Thai politics as from next year onwards.

I just hope Thaksin has no influence in the Supreme Courts. Because Yingluck and many others should really be looking at 20 years inside for this.
