Gas station altercation suspect charged and fined

PHUKET: The driver who assaulted a gas station employee in Tah Chat Chai on Thursday was charged for the altercation yesterday afternoon.

Pariwat Polsamak, 29, appeared on CCTV footage that went viral on Facebook. The video showed him kicking Usaman Satapor, 31, to the ground at a Shell gas station and driving off (story here).

Both men were called in to the Tah Chat Chai Police Station for questioning and negotiation.

Probably half a months wages for the attendant, no paperwork for the police, and a cheap price to pay for the arrogant bully, case closed.

Sad really isn't it ?

Yes, really sad. No real financial penalty for the bully. No chance of jail time, not even a real court trial, just a police station fine. Perhaps with social media then these people will be exposed and humiliated.

I really doubt what you stated.If it was true the jails could be filled with aggravated assault cases from one saturday night in Canada or America

This is exactly what is wrong in this country - pay money no further action when in reality this scumbag broke the law and should be charged regardless of how much he wants to pay the victim.

 

As long as this continues people will still keep doing it thinking they can get away with it by simply paying money if caught, the evidence to prosecute this scumbag is plain to see on the CCTV

I laughed when i read the part "As long as this continues" You seem to think it will end at some time maybe because you have been made aware of how justice is dealt here.

 It should be stated as " It shall continue because they can pay money and it is over and done with."

  So life here will go on as it always has.

Hey if you have money you can do as you please, simple. If the shoe was on the other foot, that attendant would do some time, as he wouldn't have any money to give.

my post meant exactly what it said - "as long as this continues" meaning - until the very flawed Thai justice system is fixed

But in Thailand even for many criminal type offences if the victim and accused can come to an agreement on compensation (a.k.a., money for the victim) the police will not charge the accused especially when the victim decides not to file charges due to the compensation.   It the accepted and legal way in Thailand to buy yourself from being charged with a criminal or civil offense.

Exactly the way the criminal process works in Thailand.  Financial settlement made with the BiB also getting their cut. No criminal charge filed by the offended party, case does not go any further tahn the police report and  fine, BiB don't have any pesky paperwork to pass onot a full court, everyone walks away with something.  Same as any third world legal system.

What's cheap and what's sad?  The attacker was charged and fined, more than likely involving paperwork and of course the case was closed, they usually are after a verdict has been made and punishment administered.

...but he wasn't charged with aggravated battery and one kick probably wouldn't amount to aggravated battery, even if Thailand used US charges in their legal system.

Really?  Are you sure?  How come the attacker in this case paid compensation and was charged with a criminal offence and fined?

"...everyone walks away with something".   The attacker was fined and had to pay compensation, what did he "walk away with" apart from a criminal record and a small dent in his bank account?  The police didn't "walk away with" anything.

 

So, apart from the victim, no one got anything that they weren't entitled to.  Unless you've got evidence to the contrary, of course.

My question is. Do they get a criminal record? If the perp pays the victim a compensation at the police station and also pay the fine to old bill will it go on the perps record?

So if you did a police check on the perp for say a job would it show up on his record?

So reassuring to see the Pol. Col. taking it so seriously but maybe just so happy it was easily settled and paperwork etc kept to a minimum plus he got his picture in the media.

This was an unprovoked, vicious and cowardly attack and the punishment did not reflect the seriousness of the assault, which was vicious and could have caused lasting damage to the victim.

 

Letting off young thugs - whatever their social status - so lightly is no deterrent and far from being "shamed" by the footage going viral most of them probably welcomes the chance to achieve "celebrity" status.

 

He and other hooligans of similar ilk should be made to attend an anger management course - paid for out of his own pocket.
