There was no headstomping.

Jose was out after 2 nights.

He got sentenced to 2 years fully suspended.

It didnt happen.

My sources

1 The coroner

2 Bens mate who was with him at the bar.

Odd that you seem to think that you need to back up a Coroner's report with 3rd party hearsay.

Well i knew what Bens mate had told us days before the coroner confirmed it.

I think you may be missing the bigger point though. Which is this sentence is totally inadequate, and the reason why.

Anything to contribute mate?

Well it's my privilege to post what I want to on a public forum but would you care to point out exactly what you're contributing so late in the thread?

We have tried so hard.

Initially when we discovered Jose was out on Feb 15 dazzler posted it here and we contacted the Aussie press that had been all over the story. We initially contacted the channel 9 woman who had flown over, but i think she was shocked by the whole soi 6 scene and didnt really warm to us.

So we contacted a male who worked for Fairfax media, we showed him the film we had. He totally believed us, but needed more proof for his editor to allow him to run with the story.

We hit 3 roadblocks.

1. ben's family didnt want to speak to anymore press, considering they were grieving and in shock, added to the fact how they sensationalized some parts, was totally understandable.

2 The FAIRFAX reporter had never been to thailand, didnt really understand Thainess, and the cops refused to confirm anything. After a few days we found an official to confirm that Jose wasnt in custody as reported (the headline of this thread, amongst others). The editor decided that was good enough and would run the story.

3 Then on the 23rd feb, a poster here, who I wont name, posted the following "

"He was still in Nong Plalai when I visited another American the other day. After it was reported that he was running around Jomtien, I might add"
We didnt know the circumstances of Jose being let out, so this comment threw us. We thought maybe us exposing it publicly had made the police rethink and that maybe they had re arrested Jose. We didnt know. The story was going to run the next day in the Aussie press so we contacted Fairfax to tell them of this new development, and they held off publishing.
Three days later the same poster posted that he had been to the prison and that Jose had been released when we said he had been. So we got back onto Fairfax, but by this time the editor had had enough, and it was never published.
Obviously we were absolutely filthy on that poster. We still dont get why he would say that. If he hadnt made that false claim it would have been reported and maybe something would have been done.
A couple of days later another mate saw Jose at the airport and we assumed he had completely escaped justice.

Fast forward to last month we were surprised Jose had shown up to court. Why would he risk spending years in a thai prison when given the opportunity to flee? We believe because it had all been "sorted". He had nothing to fear.
So then Gordon joined up here to report the sentence. Once again the clowns on TV with no idea said Gordon was a liar. One d1ckhead even posted a fake report from Pattaya News claiming that Jose had been sentenced to years in prison and the family had been paid 3 million in compo. It makes you wonder about these types. Thankfully that post was removed.

So now, we have given up on the Aussie press, they will only report it if it is reported here in the mainstream press. Hence why we again contacted TV as apparently they are associated/ in partnership with The Nation. We thought they would easily be able to confirm the sentence, it would cause a bit of uproar, and the justice system might take a look at it again, decide that the sentence was a sham, and do something about it.

We dont believe that Jose was trying to kill Ben, however he is a thug, who has shot someone to death over $20 previously, and it was said he was terrorizing people at the tukcom starbucks the day before he killed Ben. He misread the situation in the bar that day, and grossly overreacted. He shouldn't be on the streets. We would have been happy with a 5 to 10 year sentence all things considered.

It stinks.

Thanks for your suggestion, but I am not sure if Stickboy or whoever is associated with mainstream media.
It was an International story at the time, our only hope now is that The Nation can look into it for us and report it.

Daily Mail or UK Sun? You would think they could get an official reponce confirming the true sentencing.

Americans usually great people until you back them in the corner...Then they become very dangerous....

He didnt have mates with him laughing. It was one of the many fake claims.

other fake claims reported....

there was no headstomping. Didnt happen.

Ben wasnt causing trouble in other bars. Didnt happen.

Ben wasnt attacking Jaa, they were only mucking around.

Jose was not in jail, as claimed, after he was seen at immigration. Someone made that up.

the family didnt recieve any compensation as claimed. Again, someone made that up.

a lot of BS posted by weird people who imagine things and post as fact.

Thai yobbos outside bars are now actively trying to pick fights by insulting every farang who comes out of the bars with a girl. Your best bet is to ignore them. They are so obnoxiously insulting that this is difficult, but it may mean that you will live to see another day. If they beat you to death in a "ten on one" attack, the police will do nothing and they will be back at the bar the next night trying to pick a fight with another farang. A very few bars forbid loitering outside their bars for this very reason.

I have heard conflicting versions of events that happened at the time but one thing is for certain a lot of people are being affected by this tragedy. I do not think the guy tried to murder him and I also think it is wrong to react in such a way when you are antagonised, the poor guy who died obviously did not expect or was not aware of what was about to happen and was just doing what thousand upon thousands of guys have done for years, ENJOYING PATTAYA. I feel for both sides families as it is them who have to pick up the pieces and suffer now. Pattaya has taken a lot of bad press through incidents involving foreigners lately so hopefully things quieten down now. RIP sir you did not deserve to die.

Not seeing any compassion for the woman who was allegedly assaulted
