This is just a quick payday for Vernon. If he let it go then it would've been forgotten. Starting a lawsuit and having your name permanently tied to the accusation of being a pedophile in every major news network seems counterproductive if his goal is protecting his character.

I believe the matter would have been closed after the apologies if Musk had not subsequently said that it must be true that Unsworth is a paedophile because he had not sued him.

On 6 August 2018 Unsworths lawyer wrote to Musk: "In an attempt to avoid litigation and to see the public record corrected, I invite you or your legal representative to contact me." Could this be interpreted as an initiative to get the matter settled amicably? (Musk called it an extortion attempt in Tuesday's court hearing)

Yes it can do, but I think in this case, it's about making Musk responsible for a stupid & defamatory comment.

 

I think that Musk was attempting to use the rescue as a business opportunity, & Vernon most likely recognised this, became irritated, & responded.

 

 Musk's reply was completely inappropriate.

 

This all could have been settled with an apology, shaking of hands....a wai & 500 baht.????

For defamation/libel, burden of proof is usually on the accuser, not the victim.

The rich and famous need to behave in a way to protect their wealth, if they don't want to lose some of it.

Uh yes, quite vehemently.

 

His live-in GF (who is in her 40's) also went public about Musk's claim that Vern was a "child rapist" who had gone to Thailand top "marry a 12 year old". She stated she was no child bride, as obviously she is not.

 

Terrible that he -- and she -- felt the need to do this.

Yes. Claimed she was only 12. (She is now in her 40's, would have been in her 30's when the relationship started).

 

These particular  comments were stricken from the complaint by the judge because they were made in private correspondence but will be allowed as evidence as to Musk's state of mind.

I think the damage had already been done, especially in the community of Thai expats.


Quite a lot of posts at that time on TVF to the effect of "if Musk says this, it must be true, "Musk wouldn't say something like this without proof, he knows some thing we don't"  and "No smoke without fire".  Mods removed these on grounds of defamation but as I recall they were popping up almost as fast as they could be taken down.

 

And then there was Musk's tweet, broadcast to tens of millions of people, asking "if it isn't true why hasn't he sued me?". Responding to that with silence could well have been taken as an admission.

 

He did not sue right away,  only after repeated provocation by Musk.

That's the way I've read it as well. When you push someone into an action, (as I see it in this case) prepare for the consequences.

Big difference between being told to stick a sub where the sun don't shine and acqusing someone of pedophillia and then hiring people to dig up dirt to try and make that acquisition stick.

No I would not like it, But I also don't go around telling people to stick things up their <deleted>, but if I did I would certainly understand if they were upset with me. There was nothing to settle, Musk publicly apologise, Vernon should have apologised too, and then perhaps they could talk.

And that you ask him to deny the slur is exactly the reason why Unsworth should and will win.

He got what he deserves. Musk isn't the one that made the stereotype of white dudes in Thailand being pedos. White guys dating girls that look 12 years old did that. Vern will be known as the gold digging peso guy who tried to sue Musk now.
