Yes, for any short term rental, you need a license.

What the OP wanted was a tenant who met his conditions.  According to the OP, he did not specifically want nightly tenants but the lease did allow the tenant to sublet on that basis.  Although nightly ABB is illegal. having that provision as a clause in the lease is not illegal.
