Video: Who was in the wrong? Motorcyclist and pillion rider take a tumble as pedestrian crosses the road

Sanook reported on a Facebook post after an accident in Chaiyaphum in Thailand's north east saw two people on a motorcycle come off as a woman was crossing the road. 

 

The woman appeared to stop to allow the motorbike to pass but then raises her hand.

 

The media said that both pedestrians and riders need to take care to avoid accidents. This incident happened outside the Ratchanon shop.

 

Here at Thaivisa we are asking for your take on the accident. 

 

Who was to blame - or do they both share responsibility?

I reckon there's more to it than we see. The pedestrian appears to see them coming, doesn't try to move out of the way, and then appears to put an arm out to knock them off.

But the bike also appears to ride towards her (in the middle) instead of past her.

I wouldn't be surprised if something had happened before the clip.

In Thai logic the bigger party involved in an accident is to blame, pedestrian and motor vehicle, motor vehicle fault, motorcycle and car, car fault, car and truck, truck fault, and if you are a foreigner, no matter what you're driving or what the circumstances are, it's your fault...

She planned to keep walking and the bike was gonna go around her to the outside until she stopped and bike was coming for her so she knocked them off.

They are both wrong. Maybe they had a problem with each other before and this happened when the motorbike was leaving the area???

Indeed, she should have kept walking the bike would have gone around, stopping caused confusion.

If a farang would have been involved, there would not be a question.

 

Farang lady crossing the street, obviously drunk and not wearing a face mask. She is at fault.

 

2 dirty farangs on the bike, no face masks in place and most likely in possession of illegal substances trying to take her plastic bag.

 

I know, a bit over the top, but sometimes it just gets me.

In most parts of the world that have traffic laws, jaywalking across a street is illegal unless there is a well marked cross walk. Sometimes it is allowed if distance to corner to cross is too far, distance depending on local jurisdiction. We can't tell from the video how far her crossing point may be from legal crossing point, but barring that, I'd say

The woman is at fault

Usually I have pity for pedestrians but the behavior of this woman is really stupid.

She carelessly crosses the road without a look to the left.

Not before she reaches the center she realizes that there is traffic.

She doesn't look like handicapped/unfit.

Her survival chances in Pattaya would be in the single digit percent range.

Right, she just crossed the road without looking only until she reached the middle of the road. Motorbike that did see her was trying to go around her. She is a <deleted> with Capital C.

The biker wanted to high five her outstretched hand but lost control of his bike.

Pedestrian primarily at fault.

 

She walks out into the road regardless of the on coming motorcycle clearly expecting the motorcycle to stop.

The motorcyclist doesn't stop but anticipates the woman will continue walking out, changes his path towards the center-line to go around the woman, who then stops. The motorcycle has to adjust again. The woman puts her hand out in protest, strikes the rider and and those on the bike fall off.

 

The motorcyclist could have stopped, the mistake the motorcyclist made was not stopping and assuming the woman wasn't going to behave like a dumb tool. But it was the woman who walked out into traffic.

It appears she took  a-swipe at them but she was stood still, bikes fault.

Pedestrian at Fault .Must check if road is Clear Before Crossing if not at a Zebra Crossing. Same all over the World. Anyone says different is Wrong.

Perhaps she thought she was in Vietnam! From my experience, to cross roads in busy Hanoi, you "raise" your hand into the air and start to cross - believe it or not you will get to the other side! It is a recognized signal.

It likes like the motorcyclist had already swerved to the right anticipating that the woman wouldn't stop.

The woman hesitated and stopped in the middle causing the accident.

 

Motorcyclist could have / should have stopped. The woman should never be crossing the road until its clear.

 

BUT... thats the way people cross the road in Thailand. Cross 1 half, then stop, look the other way and cross the other half - very very stupid on a road which doesn't seem that busy.
