Immigration Looking For A Reason To Deny My Extension

For years I have extended my Visa based on marriage without an issue. It seems this year the IO is looking for a reason to deny my extension.

The first quarter of the year I was sending my deposit to SCB and then changed to Bangkok Bank. The IO said this is not allowed. All 12 deposits must be to one bank, I said I am not aware of this and did not see it on the IMM website. She said it's a rule.

I have 30 days remaining on my Visa and she wanted me to pay 1900THB for a 2 month Covid extension stating that this will give me 12 months of deposits into 1 bank.

I hindsight, I should have just paid the 1900B and come back in 2 months.

 

Today my wife received a call from IMM. They want to know why the amount I transfer each month is not the same.

I make 2 transfers each month. One is about 12 to 14,000 THB and the other is 58 to 64,000 THB depending on the rate.

There were months when the amounts were less due to purchases in the US or some unusually high bills that month. Regardless, my transfers were never less than 40,000THB, In fact I transferred more than 800,000 THB this year. In addition, proof of US income was provided.

The IO now wants a letter stating why the transfers are not the same each month.

 

Is there any rule that states I must transfer the same amount each month?

Is there a rule that stating I must make 12 transfers to the same bank?

    Doesn't matter, it's up to her, and unlikely IMO that you will win if you go against her. I could be wrong, but I wouldn't be trying to go against the machine.

There is no rule stating they have to be the same amount every month.

i have used the income option using transfers into the country from abroad for 3 years now and every transfer is a different amount every month due to the exchange rate changing.

Also there is no rule that you cannot change banks.

You could download the rules here if you want to. Amendment to police order 138/2557 See the clause 2.18 changes.

It even states a average income is allowed but many office will not accept it.

Doesn't matter, it's up to her, and unlikely IMO that you will win if you go against her. I could be wrong, but I wouldn't be trying to go against the machine.

Trust me, I'm not looking to make waves. But if there are rules I"m not aware of.. I want to know

Maybe you should consider to change from difficult marriage extension to retirement extension instead?? Money seems to be ok for that anyhow??

 

Some officies pushing from marriage to retirement, she have not suggested that

to you???? Just because you are married to a thailady, or have a VISA Non immigrant O Spouse, doesn´t mean that you HAVE TO go the route of marriage extension, it is up

to you...

So write the letter, it'll take less time than this post did.

 

Keep it short, very short, no, shorter than that and don't embellish it with the weather report from the U.S. or your purchases and bills. And get it translated to thai.

Maybe it would be easier if the OP, and others, sent the same amount in THB every month no matter what the exchange rate is.

Yes, I understand it's much easier for IMM to do a Retirement Extension. And NO, she did not suggest that I change my application.

What's the point of that? The IO's objections seem to be about his financial arrangements, not the status of his marriage

Thanks for the suggestion and the edit. My wife tells me she has sent them a letter stating that transfer rates change and there is not a single month that less than 40,000 THB had been sent.

I recall something something here about Immigration wants to see one account.

 

It does sound reasonable if one is doing income method.

 

It's only 400k and you transfer 800k per year. Avoid the drama and just let the money sit.

In my case that is not possible since it is direct deposited into my account by the provider of it.

Anyway as said it is not a requirement.

I originally used to do monthly transfers for several years for my marriage extension but changed to money in the bank so I didnt have to travel to Bnagkok and argue with the thai staff  about getting my govt notices stamped. My transfers varied every month due to the exchange rates plus when I had extra in my account from my partial business, it was never queried, really does sound like she is being a total b***h, have you tried speaking to the head person in the office

I heard about quite a few lately who was pushed around like this for different reasons, seems like some immigration officers getting desperate to get some brown envolopes, or trying to push us to use agents. 

 

Is there not possible to complain to some instance when they get out their hands like this?

She is the Captain in charge. The IO that actually did all the application work approved it and sent it to her for signature.

Yes, she made a suggestion and you refused it. Now you are a marked man! I am surprised your wife didn't advise you to do that, mine would have.

 

Best way forward, is to change to the 400,000 baht in a Thai bank in the future to avoid all this nonsense. You don't mention any monies in a Thai Bank Don't you have any?

I use agents for all  dealings with bureaucracy, Passport renewal, Driving license, 90 days, retirement extension, travel arrangements.  They offer a great service to make life easier and save so much time..

What I have in a Thai bank is irrelevant.  I have done my marriage extension the same way for years with no issues.  In addition, I'm in no position to keep 400,000 in the bank at this time as I just built a new house.

It should not be necessery when you are able to do everything yourself, especially when they start pushing people around who have been here for decades, and never failed one transfer, or have all legal necessery paper in order. 

 

One of those who was pushed around, lived here for 23 years, got embassy letter, was told they needed bank statements to, for then coming back with the bank statements, being told they also needed the embassy letter. The requiremetn is not both, it is one of them!

 

last year I was pushed around twice, finely got all papers they wanted, and showing up for my renewal, they only took my passport, embassy letter, and thats it. Nothing else, but this time I had everything. Im quite sure, if I only showed up with embassy letter and passport, they would ask for what I did not bring, but I will try next year, give them passport and embassy letter, and then hold back rest of the papers, and hand them one by one what they will ask for additional.

I see no reason to pay an agent especially when I meet and exceed all the rules. As for time, I have plenty of that..

That would be fine save that my spending requirements are often different, sometimes I need to bring over more than my usual amount, sometimes I make two transfers neither of which are below the monthly sum required.

 

I know we all have to bow before some IO's "becuse that's what I say attitude, never mind the rules" but it is quite tedious ensuring that some egos are not hurt for fear of reprisals.

That would involve buying THB in your home country, then somehow sending it to a Thai bank.

The fx rate would b even worse than when sending your home currency and having it exchanged by the Thai bank

Don’t think it’s possible  with exchange rate fluctuations. Example US Social Security 

payments using BKK bank are deposited in THB....

Not necessarily, simply check what say Bht 65000 is in eg USD on the day you need to send it, and that's how much you send in USD.

Or you could get a Wise Borderless account and 'store up' your THB and send once a month.

Don't know if this helps you but every month I send the same amount to my Bangkok Bank account from the UK using Wise [formally TransferWise].

 

On their website you can select to send a set amount in baht.  Obviously the amount you pay from your out of country bank [mine is the UK] changes, but the deposit in the Thai bank is always the same.
