When the location of the posts on the ground and the boundary recorded at the land office, and shown on the land title ( in my case Nor Sor Sam Gor ) are not at the same location ( several meters out ).   

 

Which is the correct location ? That which is shown on the land title or the location of the post on the ground ? 

 

The land is not developed and are merely land plots at this time, there are no fences erected only corner posts.

If you actually want to purchase said land you should get a new survey done, they will re-position the posts if they've moved.

 

Land survey has been conducted and new posts placed in what they determined to be the correct location ( some 7 meters from the original post ), however the land owner ( and previous owner of my plot ) has since knocked down the new post and still insists that the original posts are correct.

Let him deal with the Land Office and see who wins.

 

Question is the difference in your advantage or in his advantage.

 

Another thing, when the Land Office did our survey, we had the neighbors and the Village Chief as witness to agree on with the Land Office said was the right ones!

Go find the person who has the adjacent plot of land and come to an amicable agreement. When I first came to Thailand I was told that Thais will surely physically fight over 2 things. And that is land and women.

May be get the Poo Yai Baan involved?

The land is sloping some 23 degress, my neightbour has used the distance along the sloping plane to determine the location of the post, the land title/office use the distance along the horizontal plane ( as I understand it )...  Therefore it is to my dis-advantage to accept the location of the post according to the sloping plane as I will end up with less land than I had purchased.

 

Subsequently, the land was surveyed, posts were placed according to the horizontal plane, he did not agree nor sign the land survey.

 

He was the village cheif and does still work in the Orb Boa Toa, I live on a small island where everyone knows everyone else.   Before pushing my case with whatever civil action is necessary which will likely result in upset for some people...  I would like to be sure which has priority... the location of the ground post when the land was sold, or the size of the land according the land paper which in my case is Nor Sor Sam Gor.

if the land has been surveyed and signed off by the surveyor it is legal, doesnt matter what the neighbour says, maybe you should check the distance on his boundaries  as well to see how much of your land he is claiming and to see if he has measured his own boundary on the slope as well or just yours so he gets a bigger block himself

All adjoining land owners are invited to the survey.  If they choose not to attend and voice their views they have to accept the result. They missed their chance.

I know this to be the case with Chanote land paper.... is it also the case for Nor Sor Sam Gor ?
