Wade, the landmark ruling that established the constitutional right to abortion in the U.S. in 1973. The court’s controversial but expected ruling gives individual states the power to set their own abortion laws without concern of running afoul of Roe, which had permitted abortions during the first two trimesters of pregnancy. Almost half the states are expected to outlaw or severely restrict abortion as a result of the Supreme Court’s decision, which is related to a highly restrictive new Mississippi abortion law. Other states plan to maintain more liberal rules governing the termination of pregnancies. Wade is set to almost immediately remake how access to abortion looks in America. Twenty-two states had laws or constitutional amendments that were already in place which could be quickly used to try to ban abortion. It is still a country, made up of states. In the very small number of cases that "poor" women are so poor that they cannot afford to travel to a state like New Jersey (that still allows late 3rd trimester abortions), you can bet an unborn child's life on an outside pro-abortion organization coming in to finance the trip - and a TON of media coverage to boot. If some nutcase legislators in red states want to pass and keep truly draconian laws, they will suffer for it in due time. Yes it might take time. Like the very long time that passed since the stupid Roe V Wade ruling was unexpectedly made. American states would have had decades to "get it right" and evolve their laws according to changing cultural norms. "Poor women" can, and will, still get abortions. Wade. In his separate opinion, Thomas acknowledged that Friday’s decision does not directly affect any rights besides abortion. But he argued that the constitution’s Due Process Clause does not secure a right to an abortion or any other substantive rights, and he urged the court to apply that reasoning to other landmark cases. A very common reason for wanting an abortion is being too poor to raise the child.
