Condo Owner Fined Over 140,000 Baht For Keeping A Pet In The Unit

GOING viral on Thai social media today (August 14) is a condo owner being ordered by court to pay a fine of 141,500 baht to the juristic person for keeping a pet in the unit in violation of the regulations, Sanook.com said.

 

Drawing attention to this case was PropCons web page which runs stories on real estate and investment.

 

According to the verdict by Southern Bangkok Civil Court published on this web page the defendant was ordered to pay 141,500 baht plus 5% interest on the principal amounting to 140,000 baht from the date the lawsuit was filed, December 8, 2021, until the plaintiff receives the full sum.

The defendant was also ordered to pay 500 baht a day for maintenance of common areas from the filing date onwards till January 24, 2022 and on to February 19, 2022.

Its fortunate that the condo block has a juristic person that enforces the laws, and is willing to to take the time to go to court etc. Most of the time these condo bylaws and their enforcement is a non event.

The Juristic is usually too busy running a real estate enterprise out of the condo office.

The article doesn't mention what pet the person had, or their nationality. This is strange.

And as for having to "pay a fine of 141,500 baht to the juristic person", well does that me the juristic person gets to do what he/she likes with all that cash? Seems like a job I'd like to apply for.

Of course they dont get to keep the money, it goes into the "audited" accounts of the block, published monthly and reported at the annual meeting.

I’m not saying condo rules should be broken without consequences.  But that is a hefty total fine.  The owner must be a foreigner

The fine was 500Baht per day from when he was given notice. He then kept the pet and have been fighting it in the court for about 9 months, adding 500Baht fine a day to a total of 140,000Baht plus lawyers fees .

Some readers seem to think that the 140,000 Baht is for the personal benefit of the Juristic Person Manager ......it goes to the account of the condominium (= all owners) on which for instance also the common fees have to be paid. The JPM is appointed by a General Annual Meeting to operate this account under the supervision of the Committee. and I cannot imagine that a JPM would go to court without a vote by the Committee.

Appears to me that the title should be: "condo owner being ordered by court to pay a fine of 500 bahts per day  for keeping a pet in the unit in violation of the regulations". And the total fine added up to 141,000 bahts through time, due to the refusal of the condo owner to abide by the rules.

 

So the fine appears more reasonable now, since the unreasonable fine of 141,000 bahts is not due to having a pet, but to the unreasonableness of the condo owner.

Why not just state cats or dogs?

Thai people keep all types of animals as pets: eg. rabbits, guinea pigs, snakes, rats, mice... the list goes on. "animals" will cover most of them with the exception of insects and other invertibrates.
