Former charter court judge says court may take up to 2-months to decide on Prayut’s term limit case

Thailand’s Constitutional Court could take up to 2-months to make a call on the petition that was filed by the opposition parties on the 8-year term limit of the 2014 coup leader and current Prime Minister Prayut Chan-o-cha.

 

Charan Pakdeethanakul, a former constitutional court judge, says that he believes the Constitutional Court will take at least 2 months to ensure that the court has thoroughly considered all the facts, perspectives, and most importantly, the intent of the constitutional drafters.

 

Charan also says that he does not believe the Constitutional Court can dismiss the petition because legal experts have unanimously agreed that there should be a ruling from the Constitutional Court.

What a joke. The Thai Judiciary is a joke. Military runs the Government,  country, many Businesses  and the Courts. Third World sliding lower.  Sad.

It appears they need to employ some really good thinkers then make some unquestionable Constitutional rules and regulations ???????????? - Do you really mean to say they couldn't foresee this problem arising and make adequate preparations ?? .........................LOL

I thought the court knows already the problem and in the western world the courts can rule in a few days even not hours. Up to 2 months is ridiculous long , but everything will be done to keep him in place till at leastMarch or longer

A 2-month delay would allow time for a constitutional amendment to override the current term limitation. That "bails out" the Constitutional Court.

 

With Prayut's majority Senate in place, a majority pro-military coalition in the House isn't necessary. Unless of course the minority anti-military coalition in the House repeatedly forces a lack of quorum in the House, then the amendment vote can't go to the Senate.

    I think they will not have a ruling until after the big APEC Summit in Bangkok in November.  Prayut dearly wants to still be PM then and act as host because China's Xi is expected to make his first visit to Thailand for the meeting.  The court needs to stretch it's research of what could easily be decided in a few days.   Ok, boys, let's start our careful study of this issue by first taking a long, hard look at the font that was used.  Then, later next week or the week after we'll move on to the paper that was selected . . .

It took 2-3 months to write the entire new 2017 constitution with its hundreds of paragraphs.

 

And now the CC also needs months to interpret a single paragraph?

He can't attend the APEC meeting as PM in november if he is still suspended. That tailored shirt will stay in his cardboard for a long while.
