Supreme Court dismisses Yingluck in abuse of power case

The Supreme Court’s Criminal Division for Holders of Political Office ordered the acquittal of exiled former prime minister Yingluck Shinawatra today, on charges of malfeasance in office related to the transfer of the then secretary-general of the National Security Council Thawil Pliensri to become an advisor to the prime minister in September 2011.

 

The court also revoked an arrest warrant issued against the former prime minister.

 

In acquitting Yingluck, the Supreme Court stated that the Constitutional Court’s ruling is not binding on the Supreme Court regarding criminal liability, because the Constitutional Court considered only the issue of the qualifications of a minister and the termination of ministerial status.

 

As for the Supreme Administrative Court’s ruling related to the case, the Supreme Court stated that the Supreme Administrative Court only considered the legitimacy of Thawil’s transfer order and has nothing to do with criminal liability, which was considered by the Supreme Court.

 

The Supreme Court also noted that the testimonies of two witnesses, Buntoon Supakkavanich and Pongsak, did not confirm that there was an ulterior motive for Thawil’s transfer and that his transfer was normal and within the authority of the prime minister.

Politically motivated prosecutions shouldn't be given credence.  Only fools stick around to be prosecuted in Thailand.  

 

"The driver (or captain) fled the scene" because he knew how things work here. Let the situation cool off, show contrition, and blame the "invisible hand" so no living person loses face.  Some form of reparation and you'll be back behind the wheel (or in the wheelhouse) in no time.

Unbelievable people on here. She was ousted by what is the most serious criminal act in a democracy  "a military coup". She did the right thing and called an election and the opposition went into meltdown and tried to stop the ballot knowing she would easily win so some land was purchased and a coup was bought. The country again dragged down with Unbelievably high levels of coruption and incompetence. The real criminals walk free with justice pushed aside and any who protested thrown in prison.  Temple murders, gold mine, toyota shack down, military corruption, slavery one could go on and on. However, these are not crimes but currupt officials who stole in the rice pledge scheme are the then serving pm fault, oh what happened to all the money when the rice was sold off?

I really don't want to hear that stupid argument anymore.

A politician does something wrong. Is that a political crime and it should not be prosecuted?

And if a politician commits a crime and the opposition publishes evidence about this crime and demands that that politician should be prosecuted, what then? Should we call that politically motivated prosecution and ignore it?

Or is a crime a crime, independent of who commits it and independent of how it was discovered?

correct. and it was her police bodyguard who facilitated her escape on a private plane if memory serves me right.

Power-Abusing Lawsuit Against Yingluck Lifted

THE SUPREME COURT yesterday (Dec.26) lifted a power-abusing lawsuit filed against former prime minister Yingluck Shinawatra pertaining to a contentious transfer of the head of the National Security Council over a decade earlier.

 

The Supreme Court judges in charge of lawsuits against politicians ruled in favour of the deposed prime minister who had transferred Thawin Pleansri from the post of NSC secretary-general to that of an adviser to the prime minister in 2011.

 

The Office of the Attorney-General had filed the power-abusing case which was finally waived by court, given no proven grounds for the alleged wrongdoings on the part of the deposed prime minister.

 

Yingluck who had allegedly pushed for the naming of the Pheu Thai-backed Srettha Thavisin as prime minister following last May’s election has been residing in self-exile abroad following the 2014 coup orchestrated by army chief-turned-prime minister Prayut Chan-o-cha.

I don't know the details of the Thai laws. But basically:

- the people who commit crimes

- the people who help above to do that.

 

I.e. if I am in a shop and the shop attendant and maybe a security guard look to the back of the shop. That still doesn't give me the right to steal something from the front of the shop.

His muppets control the country , so his sister will return unpunished in a short time .

Anyway , she was ( in her time as PM ) only executing her brother's orders ...

This time , they will take care that no election results can disturb the clan ...

Once the facts are clearly established , ( Shinawatra country ) , they will bend the truth and the law that they just get what they want without the fear of ever being prosecuted for what they do .

Until the next coup , of course .

The last word , however , has the one who commands and controls the army in this country .

And that is not a Shinawatra yet ...

What about the people , the electorate in a pseudo democacy ?

They are supposed to just stay where they are and not move foreward in any case .

They are needed to legitimize an autocracy .
