Article 49

 

No person shall exercise the rights or liberties to overthrow the democratic regime of government with the King as Head of State.    Any person who has knowledge of an act under paragraph one shall have the right to petition to the Attorney-General to submit a motion to the Constitutional Court for an order to cease such act.   

 

In the case where the Attorney-General orders a refusal to proceed as petitioned or fails to proceed within fifteen days as from the date of receiving the petition, the person making the petition may submit the petition directly to the Constitutional Court.    The action under this section shall not prejudice the criminal prosecution against the person committing an act under paragraph one. 

 

 

 

You don't have to convince me that political discussions about amending the Constitution, or Criminal Code, should be considered illegal.

 

That said, staunch Nationalists and Royalists feel that allowing ANY discussions about the Monarchy needs to be dealt with extreme prejudice

A welcome result, but a long way to go given the judgement to be made at the end of this month regarding Pita's alleged abuse of the lese majeste law.

Considering 112 has just convicted a man to 50 years in prison a change in this law would be seen as reasonable by most people, and not 'abuse'.

The Constitutional Court has cleared the former leader of the Move Forward party, Pita Limjaroenrat, of the charge that he contested in last year’s election while holding shares in a media company.

 

The Court ruled that iTV is no longer a media business; therefore, Pita’s holding of shares in iTV did not violate the Constitution and the electoral law.

 

This means that Pita will retain his MP seat and the ruling paves the way for him to make a political comeback after he was suspended from performing his legislative duties since last July.

Me too. This is just another trumped up charge - article 49 was deliberately used by the outgoing "party" to stay in power when everyone wanted them to hold an open and fair election. They not only overstayed their welcome but seized power illegally in the first instance riding into town on an anti-corruption ticket only be more corrupt than every former government before them. I think anyone using Article 49 in this instance - especially after the way it was misappropriated by the former government - has not read the room .
