Swiss man in Phuket acquitted of assaulting doctor

Due to a lack of evidence, the Phuket Provincial Court acquitted a Swiss man today, who had been charged with assaulting a female Thai doctor when she has allegedly trespassed on his property.

 

The incident occurred on February 24 at a pool villa housing project on Yamu Beach in Phuket. The Swiss occupant of the house, identified as David, was accused of kicking the back of Dr. Tharndao after finding her sitting on the steps leading up to his compound.

 

 

 

 

The incident triggered an uproar among locals, who demanded the ouster of the Swiss national from Phuket and the revocation of his visa. It also led to an investigation into whether the luxurious housing estate was encroaching onto public land.

 

The court found that there was insufficient evidence to support the assault charge and ordered his acquittal.

I don’t know how he can be acquitted when there was video evidence of an assault. 
 

That said - the acquittal does bring into question the validity of comments in other threads that us foreigners are treated unequally….  This guy has received a very soft response from Thailands judiciary process. 
 

I think many of us here who see someone attack someone horribly in this manner deserves a lot worse whatever their nationality.

As the Bangkok Post reports it is called giving him the benefit of the doubt - didn't he claim that the contact was accidental after he slipped while approaching her and that it was not a deliberate kick?

You could well be right, you could also well be wrong, either way, he was not convicted.  I doubt that there was money involved as the doctor's father has said that she was upset by the ruling, something that she's not likely to say if she had been compensated.

Yes, that does not show any contact at all, visually, so accusations of deliberate, or accidental, contact would just be conjecture.

I suspect monetary donations changed hands throughout this ordeal.   TIT .... that goes without saying !

 

anyway,  he's innocent because he's been acquitted.   Make of it what you will,  but folding stuff would have most certainly been involved.

Why, rationally?  There was no evidence of a kick, just her word against his, hence the benefit of the doubt given to him.

It would seem just an exceptionally fair decision by the Thai courts, giving the benefit of the doubt.

 

So much for foreigners aren't treated fairly in Thailand.

Yep… I think so….

 

Same benefit of doubt bounces get when stamping on an errant customers head…

… “t’was just misplaced footing”…

 

After decades here this place remains an enigma - pick mushrooms in a forest & get two years in prison, kick someone and… 

 

I wonder how much the ‘benefit of doubt’ cost him… he’d already tried to bribe the Dr who refused to accept any money and wanted to see full justice. 
 

She’s been let down by her own nations legal system.

If money was involved in this stage it would have gone to the courts. For the doctor to drop charges because of a payment that would have been done months ago.

Maybe the Swiss bashing is because of the way he was screaming and swearing at the two females who were just sitting there. Contact or not, that guy sounds like a demented intolerant a hole, and he shouldn't be living in Thailand with that temper.

A sensible, balanced and just verdict from the Thai court. 

 

Well done to the judge for not letting the media circus surrounding this case pressure the court into an unjust decision.

 

Even more welcome as it will rile up the clowns on here that thought he should be hung, drawn and quartered for his alleged crimes.

Perhaps you are correct.. He was also facing allegations for illegally obtained properties if i recall. I wonder if that as well as his immigration problems also got acquitted?
