Lawyer Warns Entire Paetongtarn Cabinet Faces Impeachment Risk

A lawyer has sounded the alarm that Prime Minister Paetongtarn Shinawatra's entire cabinet could face impeachment following a complaint regarding an incomplete policy statement delivered in Parliament on September 12.

 

The warning was issued in a Facebook post by Mr. Paisarn Puechmongkol, a former assistant to Palang Pracharath leader Prawit Wongsuwan, and was reported by Naewna newspaper.

 

The complaint alleges that the policy statement contravened Article 162 of the Constitution by failing to specify the sources of revenue to cover the proposed expenses. This shortfall, according to Paisarn, could potentially trigger impeachment proceedings by the Constitutional Court against all cabinet members.

 

Paisarn described the current mood as panicked, with no clear decision yet on how to address the issue. He warned that if the policy statement is not amended to comply with constitutional requirements, the entire cabinet risks impeachment. The Ombudsman has a 60-day window to file a petition to Thailand's Constitutional Court, should this remain unresolved.

Opinions are divided on how to move forward. Some believe the government should call another parliamentary session to amend the policy statement and align it with Article 162. Others argue that making such amendments would cause a loss of face and that the violation is not severe enough to result in impeachment.

 

Paisarn described the situation as chaotic, noting that both domestic and international observers are questioning the longevity of the current government due to the constitutional controversy.

 

Addressing the legal implications, Paisarn highlighted a critical oversight: it remains unclear whether a legal team has been appointed to tackle the issue and what actions, if any, are being taken to resolve it. This unresolved legal vulnerability continues to cast a shadow over the stability of Prime Minister Paetongtarn's cabinet.

That should read: A lawyer is excited to tell the people that there is hope that the lackeys of Thaksin will be impeached and removed.

Obviously, we don't know if it will happen, but even the fact that it would happen is something to celebrate.

Next, lock up that convicted criminal again.

True, but a post-dinosaur government that was even vaguely competent would have paid advisers to cover every inch of the highway so there could be no legal challenges constitutional or otherwise.

That's what I said about the MFP and Pita. Where was their legal team? Asleep it seems. And here we have yet another petition against her, amongst many. These lawyers are professional litigants, vexatious, you might say. They probably have a whole team of junior law students doing the research. Combing through the statute books, the constitution, the penal code looking for any clause to try to bring down the government. No doubt who's behind it. Prawit and co. And more than likely the Privy Council, the Opus Dei of Thai politics. I think it more and more likely that it is they who are running Thailand. Deep State. Thai masonic lodge equivalent.

There has never been a love affair or even tolerate affair between the elites and thaksin.  The elite are opening doors and showing thaksin the stick if he doesn't follow what they want.

I guess our dear leader forgot to add what Thaksin told her in the draft. Now she risks all the cabinets positions.. OR, perhaps this is Thaksins plan to change the entire cabinet to those who do his bidding? Time will tell

Who in the electorate (aka registered voters) really cares? The last and current PM's were selected by Parliament bypassing the electorate, ie., with national elections. 

Anyone notice what has now seens to have been been forgotten? Rewriting the Constitution. Frankly, this last decade of governments has indicated how inconsequential the Thai constitution is.

Let's see if I got my facts straight, a former PM, who was wanted on charges and living in exile returns home to Thailand after a deal with the army is made to sell his soul and his party so that the army can regain some control that they may have lost through an election. A duly elected PM is set aside on trumped up charges even though he would have been the best man to lead Thailand forward into the future. And now the fake PM, the one who was not elected by the people stands to be impeached.

 

A rather fascinating turn of events. Can anyone guess would she be replaced by?

It could all just be part of the slow-moving plan to get rid of everyone that opposes the military and certain individuals/elite families. Obviously, they are most scared of MFP (now PP) and what it represents, to the point that they even did a deal with Thaksin in desperation to buy them time to get rid of MFP and its charasmatic leaders.

After that, they need to deal with Thaksin's influence in politics and his party... and there are plenty in the Thai intelligensia that are will to do their bidding by bringing court cases etc. against who they need out of the way.

The plan all along could well be to slowly come full circle back to the only political choice being military-backed parties, as all others will have been "dealt with". Can't shift that sixth sense of mine nagging me that Anutin will untimately end up as PM... facepalm that will be.
