Trump knew the election wasn't stolen.

 

His advisors knew the election wasn't stolen.

 

Trump knew his claims were "bullsh*t". 

 

Pence tried to get Trump to conduct a peaceful transition, but failed.

 

During the legal process, Trump  signed legal statements  stating that his false claims were true. This is perjury.

When Trump was informed on January 6 that Mike Pence's life was in danger, and Pence was taken to a secure location, Trump's response was:

Indeed, this was the October surprise that everyone was waiting for. The MSM will pump this until Election Day on November 5th, thus making it literally impossible for Trump to win.

The true heart and soul of Jack Smith's filing is Section 3 which begins on page 88 in which he argues that none of the allegations or evidence Is protected by Presidential Immunity. He writes:

 

"At its core, the defendant's scheme was a private one; he extensively used private actors and his Campaign infrastructure to attempt to overturn the election results and operated in a private capacity as a candidate for office. To the limited extent that the superseding indictment and proffered evidence reflect official conduct, however, the Government can rebut the presumption of immunity because relying on that conduct in this prosecution will not pose a danger of intrusion on the authority or functions of the Executive Branch."

 

The masterful arguments he goes on to present in support of the above assertions are truly compelling, and I predict that they will prevail, even if and when they are revisited by the Supreme Court.

 

 

Another facet of Smith's legal filing, per Forbes:

"Former President Donald Trump fired his attorneys after the 2020 election and replaced them with Rudy Giuliani because he would be willing to “spread knowingly false claims of election fraud,” Special Counsel Jack Smith alleged in a wide-ranging filing on Trump’s efforts to overturn the election, which claims Trump knew full well his election claims were false.

One week after Election Day in 2020, Trump told then-Gov. Doug Ducey (R-Ariz.) that he was “packaging up” fraud evidence to share with him, prosecutors wrote. But Trump never provided it. Ducey told Trump that Arizona was all but lost, comparing it to being in “the ninth inning, two outs, and [the defendant] was several runs down,” Smith’s brief recounted.

The Jack Smith case is a damning indictment of Trump's actions and character. But even ignoring it the reason Trump should never step foot in the White House again is what he did on election night 2020. Trump came out on election night and claimed victory when votes were still being counted. Only dictators do that. He falsely claimed he won Georgia, Michigan, Wisconsin and Pennsylvania as votes were still being counted. If you need to know what a dictator looks like and acts like just watch the clip. With presidential immunity and sycophants installed there will be no guardrails if Trump wins this time.
