British Man Arrested for Overstay and Insulting Phuket Officials

A British man was arrested on 27 November at Phuket International Airport for violating Section 81 of the Immigration Act (overstay). He had stayed in the country 130 days longer than permitted by the stamp in his passport.

 

The Immigration Bureau’s passport control unit at the international terminal reported the arrest. According to the report, the man was detained while undergoing departure control. It also mentioned that the 37-year-old British man insulted officials performing their duties.

After the arrest, he was taken to Sakhu Police Station to face formal charges under Section 81. While this section allows for imprisonment of up to two years, courts usually impose a fine of 500 baht per day (capped at 20,000 baht) and deportation. Until his deportation, the British man will be held at the Immigration Detention Centre (IDC).

 

Under the Good Guys In, Bad Guys Out policy, any arrest for overstaying carries an additional penalty: a re-entry ban of five years for overstays under a year or ten years for overstays exceeding a year, reported Novosti Phuketa.

Was he unable to pay the over stay fine or was he detained for some other reason ?

I imagine perhaps he didn't have the 20.000 to pay them plus his detention means missing flight so further expenses he probably doesn't have. 

In saying that if he can stay over 6 months he either thought they will just deport him but I've no sympathy

Maybe my memory but I seem to remember (some months back) a number of news items about overstayers in Phuket being arrested on departure.

   He may have been annoyed when they wouldn't let him board the flight , would be understandable if he had the overstay fine money

It is amazing how many "khun thai" students are overstaying abroad. Anybody got similar "punishment"?

I met really mean thais in [such a god forsaken place] Bulgaria and Slovenia. 

West coast of US is infested with thais who arrived on student visas sponsored by thai govt. but "changed their mind". Same in UK and EU

Does anybody charge them $15/day for overstay? Nope.

Indeed - the arrest photo with six officers for some dope who overstayed by 4+ months and was discovered only because he presented himself at the airport immigration counter seems like overkill...

Likely what is missing in this story was his "Great White Man's" attitude toward them. Something went wrong and they got pissed. No wonder - thais have very short fuse [no, not what you just thought - that is just tiny].

Yes agree if you over stay pay the fine 20,000 baht plus overstay stamp in the passport

But if you start to insult the Immigration officials then maybe a longer stay is  required

What ever happened to manners maketh the  man 

Goes a long way to be polite 😌

I never understood why they block out the face of the person they arrested if they showed his/her face we would be more aware to avoid the person let’s home he is handed over to immigration and deported back to his home country with a red stamp in his passport

agree, 6 policemen to show one man with a piece of paper, not working but must have there photo taken. now you know why you can never find a policeman. PS. what happened to to the usually fully armed SAS standing behind

I’m assuming that was going to happen until he started abusing the IOs no doubt he was under the influence of alcohol or weed !

It would have been as simple as that, but he started to throw insults at the police. In any country that's a big mistake. Unbelievably stupid.

I suspect that would have normally been the case... BUT, the report mentioned he insulted the officials...  

... So, they have carried out their revenge....   Karma sucks for this guy !!!

 

But, as Nick mentioned - the order of events may matter..

Could he pay for the fine ? 

Was he abusive before paying the fine and thus dealt with more firmly ?

 

Or, did he have anything in place, have the fine ready etc... but they decided to detain him anyway, after which point only then did be become upset ?

 

Usually the BiB are not vindictive - I would suspect they were processing his overcharge as a matter of procedure (i.e. taken to a room to pay the 20,000 baht fine - and 1 year Banned stamp) and he dug his own hole by shooting off his mouth.
