When i was walking around and relaxing and watching a normal life i saw this british guy selling hamburger. He has a carry stall or stand. Not even a shop. Speaks normal level of thai with customers.. he cooks by homself. he even has tiktok and live. Didnt talk anything with him. 

PS: i dont know if he is thai citizen already or not. 

 

Is it legal? 

He either has Thai nationality or it is illegal.

 

Street vending is a restricted profession. He would not get a work permit for anything like that and it would not meet the salary requirements for the job you have described. So there are 3 big hurdles to cross.

 

However, I have seen a Russian with a WP selling pizza through some weird and dubious company structure at a food court.

It certainly could be legal if it is part of a larger business he owns and he employs some minimum number of Thais.

It is possible a WP issued under the one-stop regulations administered by the BOI may omit duties and location. I don't know. Non-BOI work permits definitely do not. I will have to wait for an expert to come along.

 

BOI will not be dealing with this hamburger stand. So for all the reasons I stated above, including location and duties, this unnamed English guy does not hold a work permit for foreigners to do what he was doing. He may hold Thai nationality.

Under the Royal Decree of 2018 (unfortunately we can't attach pdf anymore) there are a few things that have changed, including the points you mentioned. For many there is no fixed address of work and no exact work description anymore. I can confirm as I had an "old" work permit and a new one now.

Thank you for updating me. I was unaware of that. I just had the "old" style of work permit.

Where was this. In a tourist area he won't long survive the attention of the police. I have seen foreigners doing similar things in rural areas but always with their wives / girlfriends.

Well i saw him in bangkok and he was next to a university. Lot of people too around.

Had one in Udon Thani. Used to sell (maybe still does) outside Fruit market/Makro. Hearsay was that immigration picked him up. he explained he had a son to look after, no wife. They let him go, If he tried selling Som Tam, might have thrown the book at him. Very few Thai burger stalls.

correct but there are some rules. for example if he owns the company 49% he can be only in position of adviser or marketing. plus company must sell abroad. also farang cannot help any work such as making furniture and sell. he can do the selling part but cannot do the making part. if a foreigner do a work it means thai national not qualified for the position so the company needs a foreigner. Also street selling is 100% forbidden to farangs. also making a hamburger dont need a foreigner cook. 

so most likely hes doing this illegal and im so surprised no IMM checked him. he even has tiktok. and he sells ramkhankeng area near the university. 

i dont know maybe he has some kind of permit or maybe hes thai citizen.
