As someone directly involved in the accident you are unable to determine fault. This is why insurance companies say NEVER admit liability. That's for police/courts/insurance to sort. You are factually incapable of determining that and more than likely under shock, even in minor accidents. 1

Not that I'm getting upset about it, but how is that worse than people not wearing a helmet or seatbelt? The former is just an opinion that might lead to a comment, while the latter leads to people literally dying. 1
