Does anyone know the order of inheritance in Thailand? Is the surviving parent first in line when an adult child passes away? If so, but the surviving parent has no interest in the inheritance and understandably not want any inheritance from their own child. How is the inheritance then divided between the siblings of the deceased?

Thanks

Did you ask Google?

I have the answer someone in a folder on this computer, but at present I do not have the time to look for it (medical appoint at 1000).

From Google

Order of Inheritance (Intestate Succession):

  1. Descendants: This includes children, grandchildren, and so on.
  2. Parents: If there are no descendants, the parents inherit.
  3. Full-blood Brothers and Sisters: If no descendants or parents, full-blood siblings inherit.
  4. Half-blood Brothers and Sisters: If no descendants, parents, or full-blood siblings, half-siblings inherit.
  5. Grandparents: If no closer relatives, grandparents inherit.
  6. Aunts and Uncles: If no closer relatives, aunts and uncles inherit.
  7. Surviving Spouse: A surviving spouse is also entitled to inherit, subject to specific provisions in Section 1635 of the Civil and Commercial Code.

Do I understand correctly then that in practice the surviving parent can with the law in hand distribute the inheritance to who and the way they want to full-blood brothers / sisters to the deceased?

Thanks again

Effectively yes. If there are no children and a surviving parent inherits, once they have whatever inheritance there was they are free to dispose of it as they see fit.

That is the order if there is no will (intestate).

Inheritance order is only applied in probate court when there is no Last Will and Testament.  So if its your assets, have a Will.

I appreciate the response above, but it's hard for me to believe the Surviving Spouse is not at the top of the list.

I think you can change that with a simple Will - I was able to have a lawyer put down my exact wishes for a nominal fee.

Me too, very strange indeed, there appears to be a strong emphasis on "blood relatives" Its  Probably designed with the Uber rich in mind so they can ensure their billions stay in the family  and prevent the bimbo widow from frittering it all away.

I understand amongst siblings (assuming both parents have died) is the first in line is the youngest daughter. I know of a family the youngest daughter inherited the land despite she was actually adopted. That assume no formal will prepared, which Thais do not usually have a will as think it puts jinx on you (bs)
