Landlord didn't pay maintenance fee, now condo keycard locked

Hi, 

so i live in a condo here for around 6 months now but unfortunately the Landlord didn't pay for building CAM and maintenance fees. 

Therefor the juristic office locked all access cards and I can't enter the building. It's super inconvenient now as I have to wait for other people to go to the elevator, etc and I can't even use the stairs because they locked the door there as well unless its open by coincidence. 

I still have a half year left in my lease and to be honest I don't want to break it now because I like the location, price and I paid around 30.000 deposit which I don't want to lose.

I have contact only to the Agent but they are slow and keep me waiting for days without any useful update. Also my girlfriend tried to talk with them in thai multiple times but she hadn't much luck either. 

Do you have any ideas what i can do besides moving? Could a lawyer help maybe?

Is there any kind of "rental board" where tenants can take their disputes against landlords in thailand?

 

I doubt it, right?

I agree. Unit owners own part of the common spaces via common fees, so they would need to be working. The common fees are attached to the owned property. Even if the fees were unpaid they are still responsible.

 

However, only a court would look into it, not the people evicting. The renter would be long gone by then.

The landlord is in breach of the rental agreement. A lawyer will know what to do.

You can't "create a triangle" to get out of the rent. The contract was between the owners property and the tenant.

Non payment of CAM fees is a common problem in most condos.

From my previous knowledge of being on a condo committee a long time ago, i do not think the condo can do that.

We only identified that services like water and electricity could be cut off.

I dont think that has changed.

At another condo annual meetings in the last few years the subject has been discussed and the commitee was saying that there were limited options for what to do. Mainly cut off services.

Eventually take the owner to court, but it takes a very long time.

Have you searched the web on this subject?

Does the condo state in its rules that they can do this? They may have added a rule if passed by co-owners.

Ask the condo what is it that permits them to block access.

IMHO, you likely need legal advice.

May be you can pay the Fees and cut it off from the rental?

Sounds like a good idea but i feel certain the rental agreement will not cover him for that.

Also, it depends how long the CAM fees may be overdue. 

Likely to be years, from my experience condos do not normally take action unless repetitive for long time measured in years.

I rented this time from building management. Skipped private landlords and agents altogether. Good luck with the rental. 🤣

Is the Landlord Chinese?  Where I live the Jurassic office lady tells me Chinese rarely pay their fees.

 Farangs have no rights in Thailand.

Does building staff understand the nuance between the access card being locked and unit access?

 

Typically, common areas can be locked out, but not access to the privately owned unit. Possibly requiring you to ask for access each time you enter during business hours. Most Thai security would not be educated enough to understand this, however. They could view you as an intruder trying to get in with a non-working access card.

Then you move and they will lose your rent money.

Problem is huge deposits. 

Back home, you may have "right" technically but do you want to getting into spats with the landlord? They will make your life miserable once disputes start, so it's best to only fight for major things and if they don't budge, it's best to get out of there. 

 

My landlady is Thai and married to a Brit. She is also my visa agent. I have no problems with her. She provides my live-in girlfriend with babysitting work for her Grandchildren.  No problems yet, that's not to say that there won't be.

I don't like my landlady and she is always in the main area trying to make conversation and it's painfully obvious that I am avoiding her, so I expect her to cause me problems soon to get revenge for not being liked.

I find places where I can get in and out without facing the security guy or front office, or just people in general.

 

My place now has them, but they are in an enclosed a/c area so they see me coming and going, but there is no interaction, so that feels fine.

 

The worst situation is when they are right by the access door. Just something to think about if you're a bit unsocial renting in Thailand. Check it at night and see where the security guy sets up shop. They will often move the inspection table into position at nightfall, not during the daytime.

My landlady is the best person I could possibly have. I am sure that her Brit husband is partly responsible for her enlightened attitude. She is also very close and kind to my live-in girlfriend, who babysits her grandchildren. The landlady assured me that the girlfriend was a "very good lady". That's good enought for me.

My communication and interpersonal skills are getting worse daily.

I am regressing into a Neanderthal in Thailand. 

 

I'm not sure if it's me or her.

She's a strange person. She is in wheelchair. She had a near death experience in a car accident and then became a monk. She never leaves the home. Her only social outlet seems to be her mother, and the cleaning lady. And she hangs out in the corridor. 

I tried to be exceptionally nice at first particularly because she is a monk and had an accident and I was trying to show sympathy.

But there is something "off" about her. I can't quite put my finger on it. When she smiles and says hello, it seems more fake than a bar girl smile. She creeps me out. 

I think I need to move out of here.

If you have a contract and your payment invoice, you can contact the police to gain access! The property management must clarify this with the owner and cannot deny you access.

 

You can also contact the Consumer Protection Bureau (OCPB) to help you and give management a slap in the face!!! In Pattaya is their office in the Cityhall, North Pattaya Road, opposite Lotus!!!
