Looking for advice on the legal status of what's happened here:

 

Over a year ago an AGM proposal to increase common fees was voted down.

 

A few months later the management committee voted through a temporary (2 year) fee and have said that an AGM vote is not required due to the temporary nature of this fee.

 

Are they correct?

I don't know of the "legal status" of what they voted through. All I can add is that our condo fee has remained same since 2010. I have suggested raising it a couple of times at AGM and they told me "this is how we do it in Thailand" i.e. Not increasing the fees but having an extra one-off balancing payment by end of July to make good any shortfall and bring the accounts back level. I accept this now. Either way, so long as the place is managed and maintained and you have no question with expenditure, it will work out at the same cost.

 

We had supplementary fees that from memory were still voted on at AGM, lower % required i think

You probably need to read the condo act, it's online somewhere.  I'm guessing your management committee has done that, but they could be wrong.

 

It's important your condo fees are enough to maintain the building properly or your own condo's value will plummet.

I can see a reference to a lower %age (25%) of votes required for some actions but so far only for appointing/removing a manager and for specifying business a manager can delegate.

I've had a look through it but still unsure due to all the legalese.

 

I'm keen for it to be paid and have everyone pay (and I only rent so not out of my pocket) but want to ensure it's all been done legally so those that are reluctant to pay can be chased down the legal route.  So far I'm not convinced, hence my request for opinions here.
