You are talking about a 12 month extension of stay based on Thai Wife or Child.

Yes you apply at Immigration in Thailand.

2.18 In the case of a family

member of a Thai(applicable only to parents, spouse, child, adopted child or child

of his/her spouse):

Permission will be

granted for a period of

not more than 1 year at a time.

(1) The alien has obtained a temporary visa (NON-IM)

(2) Proof of family relationship

(3) In the case of a spouse, the marital relationship shall be de

jure (legitimate) and de facto;

(5) In the case of a parent, one of parents must have an average annual income of not less than 40,000 baht per month or a money deposit of not less than 400,000 baht for expenses within a year.

(6) In case of marriage with a Thai lady, the husband who is an alien must have an average annual income of not less than 40,000 baht per month or a money deposit in a local Thai bank of not less than 400,000 baht for the past 2 months for expenses within a year.

If you are talking about extension of stay or conversion to extension of stay and can meet the 400k/40k requirements the above is the procedure.

If you are talking about a non immigrant O visa for 90 day stay that would be obtained from a Consulate outside of Thailand. But there is a 60 day extension available without financial strings available from Immigration for 1,900 baht.

Thank you so much for your help!

My husband currently has tourist visa and have income from and pays tax overseas. He had a business before in but he sold almsot all of it. He still has a little income from his % of his ownership, the rest is owned by the japanese.

Is it enough to show that you have an income every month in a non-thai bank for the last 12 months?

Thanks again and take care,

You are Thai? It has not been confirmed and rather important to be sure.

He would require the income to be listed on a letter from his Embassy if from outside Thailand. What the Embassy requires to write such a letter will vary by country.

Oh i am sorry.

I have european citizenship at the moment but i am born thai (adopted to europe). The thai authorities have problems putting me back in the national register. They need more proof...it is complicated.

We will ask the Embassy and see what they say.

Once again, thanks guys for fast replies and good facts!

Take care now,

If you do not have a Thai ID Card your Husband will not qualify by having a Thai Wife.

I assume your Child is also Swedish which would be the same problem.

A shame that your Nationality problems are still going on after all this time.

Yes, it is....:)

I have even contacted TV about it.

Modern Nine have a program for people looking for their families.

They have all my documents (copies) and i have written everything i have done myself from start until now.

I try not to keep my hopes up but maybe there is a slight chance that they can find something that can be of help for us.

Take care,

You also need a guarantee letter from a Thai bank, to get a “Support Visa”. (Put THB 40.000 into a thai bank account, that is enough.) It's no longer enough to have a monthly income of more than THB 40.000, paid into a foreign bank account, even if you have a letter from your embassy that confirms this.

I got new “Support Visa”on the 17th of June this year, so this I know.

This is not the norm but each Immigration Office sets it's own requirement.

What type of visa are you curently on? Do you work and have a work permit?

Since you don't have proof of Thai citizenship and he can't use the option for people being marreid to a Thai citizen, he could go for an educational visa. He can study anything, as long as the school is recognised. Doesn't have to be Thai and would require to atend school/university for at least 4 hours a week.

It is an option till you have sort your nationality problems out.

Good luck with your ongoing battle, hope you will have good news to tell soon.

Thanks a lot for all the advice, and Mario for your neverending support in my struggle!

Havn't heard anything from Modern Nine since beginning of january and they said it was a complicated case that probably will take time.

We'll see. What is meant to be will happen, sooner or later.

Take care

Lite Beer is wrong as I applied for my "non immigrant support Visa" in September last year and got it based on an income of 75000B a month paid into my Thai account from abroad and a letter to gurantee my income from the UK embassy and a letter of gurantee from my company.

Didn't even need a letter from my Thai bank just a copy of my bank book. 40,000B monthly is enough if you want to do it that way or get a Thai bank account with 400,000B+ in it for at least a month. I only had a bank balance of 3000B in my account as it was the end of the month when I applied and I had it accepted within a week.

You might have to try several different banks to open an account as I don't think Siam Commercial Bank will let you open an account anymore without a work permit which is a new policy.

If your officially married in an ampour government office it's quite straightforward

Good luck.

PS Suratthani has the best, most friendly and helpfull immigration office I've ever been to!
