kinnear reports directly to ashley, pardew has to report to kinnear. that's about as clear a case of constructive dismissal as you'll ever see. pardew should just walk out and sue ashley now and save time.

Yep, it certainly seems like a constructive dismissal, I don't know why he just didn't employ Coco the clown as doctor of football, and really make it obvious.

Sorry chaps but in employment law, just putting in a Dir of Football (another layer of management) is not enough to try and claim constructive dismissal. Many clubs are and will be doing the same, so it's not an unusual situation. Constantly overruling Pardew's decisions, or deliberately going round him could build a case but that would take time.

I think it would depend on how Pardews role is chages by this appointment.

Bladdy heck. I wrote a detailed post on employment law then and it disappeared. I've been getting that a lot lately. sad.png

Anyhow. In brief. Your right if they changed his role. However, we don't know the exact terms of his contract but he would still be manager and would still be on the same salary. Demotion or wage reduction are key points (but not limited to) in constructive dismissal cases. Restructuring alone isn't just cause, otherwise half the country would be claiming it and so he would have to prove a serious breach of his contract in some other way.

I dont really see the appointment of a director of football as an issue that pardew will be against, probably save him a whole lot of hassle, what appears to be the issue is kinnear himself , he aint that bright and already is seemingly unwittingly creating a 'war' with the media, the trouble is i dont think he realise's with that, he's in a no win scenario he seriously needs some help in dealing eith them cos if he carries on as he's done so far as sparks say's things can only end in tears, his.

One comment that Mr K makes in his rambling interview near the end when asked what he had to say to the Newcastle supporters who oppose his appointment "I have got more intelligence that them" sums the man up. In one word he is a complete w*****.

Kinnear as spent 6 months in football in the last 10 years so the next step will be to get Dennis wise back with Souness as manager. The circus will then be complete

Doesn't it seem that Ashley has got a circle of 'Jack the lad' friends that he's desperate to employ,in some capacity,at the club? Maybe he misses his 'knees up mother brown' sessions down Saarf.

I don't doubt Mike Ashley's ability as a businessman, but I do wonder about some of his footballing decisions. I wonder if by employing Kinnear he is trying to force Alan Pardew into resigning. He was close to getting the sack at the end of last season. I cannot see it working between Pardew and Kinnear. The thing that is keeping Pardew safe is the silly 8 year contract Mike Ashley gave him.

It needs a true Magpies fan to buy the club, like Sheikh Jaber Mubarak.biggrin.png

didn't keegan sue ashley though for bringing in that poison dwarf dennis wise over his head? and won?

Yes he took Ashley to a Premiership Arbitration panel and who his claim for Constructive Dismissal the tribunal ruled in his favour awarding Keegan 2million pounds.

I know he threatened to but I don't know if he went through with it or won (if he did).

But just because one guy may or may not have, doesn't mean another will get the same outcome. I believe Keegan had in his contract that he had full control over transfers but they got rid of was it Owen and Milner behind his back and brought others in who he didn't want. Also, the fact that Keegan attempted to sue would ensure that Ashley wouldn't make the same mistake twice and I doubt he would agree to the same terms being put in any future contracts.

Listening to Kinnear the other day, he made it clear that it would be a joint decision between him and Pardew on transfers. I'm not saying that Pardew won't have a case in the future, should he be constantly undermined, I'm just saying he wouldn't win if he walked now.

He was originally going for 9m, as that was what the remainder of his contract would have been worth, had he stayed. So he only got 20%+ of his original claim.

Keegan won because Newcastle constructively Dismissed him by signing Ignacio Gonzalez on loan against his wishes.Keegan had been misled to believe that he had final say on player transfers. They broke the conditions of his contract by signing the player without him agreeing to the signing. The club also admitted to misleading the media and the fans. Several key senior members of staff including Llambias and Wise also admitted they publicly claimed that Keegan had the final say, and said this was not the case they said it for PR only. Wise only watched Gonzalez on you tube and asked Keegan to sign him on that basis.

Newcastle deny row after ripping down iconic 'Shearer's' sign outside bar
• Work on revamp began before Shearer criticism, club say
• Bar's name is being changed from 'Shearer's' to 'Nine'
http://www.guardian....hearer-bar-sign

Newcastle United are adamant the ripping down of the iconic "Shearer's" sign at the entrance to the St James' Park bar named after the club's former striker is not connected to Alan Shearer's scathing deconstruction of Joe Kinnear's appointment as director of football.

Club officials said the wrecking crew began work on Wednesday, hours before Shearer's caustic comments were published. "It's purely coincidence," the official said, explaining that the decision to revamp the popular venue situated beneath the Gallowgate End was taken some time ago.

However, the fact that, eight and a half years after its opening, the bar is to be renamed "Nine" will inevitably be interpreted as a slight on the former England centre forward. Newcastle say Shearer has been kept abreast of developments and did not object to the switch to "Nine".

John Irving, Newcastle's finance director who is currently helping fill the void created by Derek Llambias's sudden resignation as managing director on Wednesday, said: "Shearer's Bar was immensely popular when it was first launched in 2004 but its popularity has dwindled over the years as this part of Newcastle has developed and new bars have opened around it.

"In transforming the site and opening the bar up to a wider range of visitors, it was important that a new name remained in-keeping with the club's history and heritage and Nine is certainly faithful to that. We have liaised directly with Alan to keep him abreast of the plans, which he has been appreciative of, and we're looking forward to launching Nine next month."

As part of a special launch event, Newcastle are planning to raise funds for the Alan Shearer Foundation, courtesy of a special charity auction of exclusive items to benefit the charity's work in supporting children, adults and families with disability across the north-east. It is unlikely that Kinnear will be attending after Shearer used his column in the Sun to lament his installation, something Kinnear announced in the media two days before Newcastle officially confirmed it.

"Right now people are laughing at the club I support and that sickens me," wrote Shearer. "I promised myself years ago to never be surprised by anything which happens in football, particularly when it came to Newcastle. But this situation really is stretching it a bit."

Shearer, who back in 2009 briefly took charge of Newcastle after Kinnear's first stint on Tyneside ended with the former manager being rushed to hospital with heart problems, feels considerable sympathy for Alan Pardew. "Newcastle have a manager who has just been totally undermined," he said. "I'm sure it will be a difficult situation. It's no way to treat a man who 12 months ago was manager of the year after guiding Newcastle to fifth place. He is in such an intolerable position.

"What are the players to think when Joe Kinnear can't even get their names right. It's all a PR disaster. Mike Ashley just keeps on making too many decisions which alienate the Newcastle fans. They deserve better, much better."
