PM Yingluck awaits Constitutional Court decision on extending deadline

BANGKOK, April 18 – Thailand's Constitutional Court was non-committal regarding its response to a request by caretaker Prime Minister Yingluck Shinawatra to extend her deadline for presenting clarifications on the transfer of the former National Security Commission (NSC) chief for 15 days.

Chaowana Traimas, Secretary-General of the Constitutional Court Office, said the premier’s request will be submitted to the judges’ regular meeting on Wednesday.

Ms Yingluck yesterday asked her lawyers to seek Court approval for a 15-day extension on presenting her clarifications on the controversial transfer of Thawil Pliensri as NSC chief to an inactive post two years ago.

Mr Chaowana said Ms Yingluck’s request will be included in the agenda for Wednesday’s meeting of the Constitutional Court.

He said the judges’ consideration of the case will be free of political motivation, and that that the judges did not feel pressured despite widespread criticism from various quarters in Thai society.

The judges strictly abide by the constitutional framework, he said.

Somrit Chaiwong, Constitutional Court spokesman, said it would be up to the judges whether the prime minister’s request for an extension of her clarifications will be approved.

If the judges decide against the extension, a new date will be set for her, he said. (MCOT online news)

hahahahaha, she will be sh*tting bricks waiting for the answer to this. Can you see her trying to physically answer any questioning herself, she is totally illiterate when it comes to talking, even thinking causes her to panic as she isnt capable of it without someone to give her the answers.

They are hoping they can delay justice until the next election, that puts them back in the driver seat and makes them immun to any court case. High gamble indeed.

Hahahahaha, Mark will be sh*tting bricks when the CC applies the laws for him and any of his MP's that did not vote in the Feb 2 election as if they did not? then they are not eligible the contest the next election, The possible get out of jail free card is that the courts will rule yes he and his MP's broke electoral rule (laws) but as the election was nullified it doesn't countwhistling.gif

I think YL will more than likely be fired from the job, just as the last voted PM was stolen from the people, Some one (neutral, yellow)will have government for 3-4 years and the PTP or some reincarnated entity will contest the next election and win, will the minority try for a third time? we don't like you, we don't like your government, we don't respect your vote, Why do the minority not see this? BANGKOK: -- Dr Ukrit Mongkolnavin, chairman of the Independent National Rule of Law Commission, said Friday that Constitutional Court has no authority to accept the case against caretaker Prime Minister Yingluck Shinawatra related to the transfer of the National Security Council chief.

Ukrit said Yingluck and her Cabinet have already been out of office since Yingluck dissolved the House on December 9 but they simply are now acting as a caretaker administration.

Ukrit said Yingluck was also using her administrative power to transfer NSC chief Thawil Pliensri so the transfer should be regarded as interference in the affairs of permanent officials as alleged by a group of senators.

I hope she is making good use of the time in preparing her defense between now and when the judges meet to decide if she gets an extension.

Should she be given an extension it should be dated from the date she was supposed to appear not from the date of the judges meeting.

Even if they say no that she must appear before them the day after their meeting it will still mean she has had six extra days to "prepare her defense"

And before the 'but Suthep' red trolls get into things.

When he did not turn up at the courts to answer charges, even though he sent lawyers in his place, a warrant was issued for his arrest.

Lets see the same standard applied to Yingluck.

Yingluck needs to realize that this is the highest court in the land. By issuing a request through her lawyers for an extension the day before she was to appear before the highest court in the land - on a case that was two and a half years in the making, that was ruled on by the Administrative Court - last May - and by the Supreme Administrative Court - in a unanimous decision - she has not shown respect for the court, let alone her rantings on facebook, and any other drivel she has managed to utter in public since, and has likely not impressed the judges regarding her sincerity. Yingluck' sincerity has not been under question for only the length of this case, however. It started when she was first campaigning for office. She affirmed in no uncertain terms on the campaign trail that Thaksin had nothing to do with Pheu Thai or the administration she was hoping to lead. Two and a half years later, after all the sykpe conferences, after the passport issuance, after the amnesty bill, and on the eve of a massive Pheu Thai sojourn to Hong Kong - sincerity is yet another word that Pheu Thai has had to continually redefine.

Yingluck has made several requests of the judges of the court and that's the long and the short of it. She hasn't ever attacked or criticized the CC as she knows better, has the support of her advisors, and doesn't need to scamper around all the time looking to invent eccentric narratives.

Several legal experts have offered their professional opinion over a time now that the Thawil case is not within the jurisdiction of the CC based on their reading of the constitution. Honest people can have honest differences, even here where Diogenes himself would meet with his greatest frustrations.

This is the only topic she could speak on for 90 minutes without notes. Then she burst into tears recalling the farmers that had comitted suicide due to not being paid and it took her 30 minutes to regain her composure.

And by the way the only thing I'm afraid of is running out of Leo on the weekends when my friends come over.
