Suthep acquitted of defaming Thaksin

BANGKOK: -- The Supreme Court today acquitted Suthep Thaugsuban of defamation charge brought against him by the fugitive ex-premier Thaksin Shinawatra for saying he wanted to become president.

Suthep, who was then deputy prime minister in charge of national security, told members of parliament during a meeting that Thaksin phoned in to address a gathering of the redshirts to encourage their morales because he wanted to return to power as a president.

He later repeated his words during a press interview.

Thaksin then designated a lawyer to sue Suthep of violating Sections 326, 328 of the Criminal Code.

The Criminal Court (the first court) acquitted Suthep of the charge with reason that his statement in the House was a sincere expression of opinion, while the Appeal Court also shared the same ruling with the first court to acquit him.

At the final heating of the case today, the Supreme Court also agreed to the rulings of the two lower courts and acquitted Suthep of the defamation charge.

Hmmmm and yet when Thaksin made a comment and personal opinion about a certain member of the privy council it was different?

At least it's now been laid to rest and that Thaksin doesn't want to be President as the courts have agreed otherwise ;)

These defamation laws and the entire judicial system seem to be missing in terms of reforms, heaven forbid the ability to take action to knobble your political opponents !!

Serious reforms are needed to stop the rich and powerful from being above the law.

How could anyone, even a slimy worm like Suthep, possibly defame a rotten, lowdown skunk like Thaksin ??? Cannot believe this defamation charge even reached the court, even in the Land of Litigation.

That bit about the rich and powerful being above the law, were you referring to Thaksin ? Because I thought it had already been established that he was in fact above the law. In his eyes, anyway. biggrin.png

Whatever gets said in parliament should be protected by parliamentary privilege.

Sincere expression of opinion. Right ho. That basically means it's impossible to defame anyone ever, if you are sincere about it.

yup same as decisions made in Parliament! so no suing after a government leaves by the NEXT government!

so a convicted criminal on the run and hiding from thai justice so he doesnt have to go to jail or face even more charges is allowed to take someone else to court for saying rotten things about him. Just goes to show how pathetic the law is, to even take someone to court the accuser should be present or at least not having an arrest warrant hanging over them. Doesnt matter who the defendant is (even a snake like suthep), the law should be above this, those whinging about it show just as much lack of intelligence as thaksin

Funny, but every time there is a topic about Thaksin or little sister being hard done by the same old usual suspects come out with the same old tired and worn out complaints about injustice, the Thaksins being picked on, Suthep being above the law, etc etc etc.

Guess what ? It is getting you nowhere, Thaksin is still on the run avoiding the Thai prison cell that awaits him, Yingluck is still waiting to be grilled by the courts, and Suthep is living it up laughing at the pair of them.

All your hollow complaints do is give some of us something to laugh at. clap2.gif

totally BS: these are two pairs of shoes. I can understand your anger (or even cannot), but he gets the right to sue anybody.

Suthep is Thailand's greatest hope. He is without blame, as pure as the driven snow, and does not even cast a shadow. I was told he pees chardonnay.

OK got it. 2 low-life. Only one has conviction while the other is and will be always be protected. Technically only one is a criminal while the other has a laundry list of charges but never convicted or even banned from politics. whistling.gif

No. First, the poor don't have any access to the law. These crazy defamation suits are only brought by hi-so's in order to inconvenience and damage their opponents, whether in politics or in business. Second, in countries with real legal systems, you must submit yourself to the jurisdiction of the court, and personally appear for testimony, in order to proceed with trial of a civil or criminal prosecution. It's ludicrous that the case was allowed to proceed to trial in the first place, without Thaksin appearing or testifying.

The Certain member of the privy Council was not a criminal fugitive like Taksin so the comparison is utterly ridiculous.

These crazy lawsuits have to stop, both sides. . Thailand is becoming as litigious as the US.

If Thaksin feels he was wrongly convicted- he is free at any time to return to Thailand. A Thai citizen cannot be denied entry to Thailand. Let him come back, face the courts, use his billions to hire the best lawyers. If he is innocent, what is he afraid of? He claims he has millions of supporters here in Thailand.

A good post. All these posters ranting about Suthep is quite a change from those who were supporting him when he got rid of this shins. Now they're all calling him stupid names and making groundless accusations too, but I guess they must be redshirt supporters who are very upset that he achieved what he set out to do. He still has tremendous support in Thailand and it would not surprise me to see him as Prime Minister one day. Maybe he should sue all the ranters for defamation

He's a filthy skunk, as bad as the rest of them if not worse

Among the most despicable of his crimes include being in charge of distributing land between some poor farmers and he gave it to his millionaire friends around 2009 I believe

He also scammed hundreds of millions in a dodgy palm oil deal when he was in charge of that and he also happened to own the refinery to process it and sell it back to the govt at a hugely inflated price ...

Allegdely gave his sons over 100 million each when the pdrc was collecting money in bkk rally.....

Need I go on?
