Hi Everyone

Short story is the wife was arrested and charged with working in the wrong place as her Employer was changing locations and had not changed the address on the work permit.Finger printed,photographed and jailed paid "Bail" of 20k which went to 50k when the Consul got involved.After court was done 2k fine BUT passport was retained by police who now say passport has to go to Immigration and could be deported for a 2k fine which was not even her fault

A court would have to make the decision for deportation. Immigration cannot do it on their own. Work permit violations are handled by the labor ministry not immigration.

You need to consult a lawyer , whom I'm sure would straighten things out for your wife .

i went through this in pattaya with my work permit from koh samui. i got my passport back once i paid the fine. dont know what else they want, probably a bit of an extra cash fine. you need to get a lawyer to enter negotiations for you.

I have had close calls with both 'address permitted to work', 'description of work/Job Title' and even the 'spelling of my name' written in the Work Permit (WP) during the last 20 years in LOS.

Penalties (payable by the WP holder) on infringing the employment conditions are clearly stated on the last page in both Thai & English - enforcement of the rules in Thailand is often draconian to say the least. In addition, you will be jailed until everything has gone through court unless you can find bail money. This can take some time.

Thus it highly recommended that the WP holder check what's written in it to ensure that the work duties, location of work and everything else are all correct. If anything is wrong, get your employer to change it.

The issue then becomes that WP holders are by definition non-Thai and likely don't read or write Thai. In this instance I advise all WP holders to get a professional translation done of the information in your work permit so you understand the limitations that apply to your duties and that everything else is correct. I can say from experience that having Immigration Officers discover mistakes in your work permit followed up by a trip to the pokey is something no one wants to experience.

OP, where are you located and what nationality is your wife?

Even when we sometimes believe that the employer should have done that, the holder of the work permit has to inform the DoL within 7 days.

It could be that she did a different job, different wages, etc..so they only followed their own law.

Each country has it's own stupid laws that unnecessarily ruin the life's of otherwise honest people from other nations.

Updating a work permit is the responsibility of the holder, not the employer.

Maximum fine of 20k and the possibility of the work permit being revoked. Deportation is another matter however.

Sorry about your predicament but can you give me some insight into the type of work the work permit covered.

So many are technically breaking this category but I wonder if she was singled out because of a borderline occupation - such as tourist trade?

That would make the WP a burden to carry with you ? because how many "officials" would be considered being "competent" ? Could be a very thick book...
