I wonder if anyone could help me through some advice, please - I sold a second hand toyota pick-up which has been in an accident. I sold the car to a car tent in Bangkok which was fully equipped with a garage and mechanics. The salesman part exchanged a new car for my car and cash. I made sure that when he was looking at my car I lifted the bonnet and told him it had been in an accident.

Now 3 months after the exchange the dealer is asking for paper work detailing the accident and is trying to get money from us. The car’s blue book is now in my wife's name. I feel that I notified the dealer of the accident and being a professional he should exercise due caution when purchasing a second hand car. Please could you let me know if I need to provide evidence of the accident and repairs or basically it is not necessary. I feel it is a used car which is sold as is. It was sold to a person who works as a car dealer in a car tent who would be expected to know about these things before making a deal and exchange. I am concerned because he is hassling my gf and even mentioned the police. These calls always seem to come at the end of the month

Caveat Emptor. What if the damage had been done previous to you buying the car? Would you still be responsible for letting the dealer know? You may have been totally unaware of any previous damage. I think the dealer is just trying it on.

Since the car is still in your gf's name, it sounds to me he has not been able to sell the car, and is now trying to get out of the deal.

I'd tell him no.

It seems he can't sell on the car and is trying push it back on to you.

Does he owe you any money or you him ?...

Any idea why you didn't transfer the Blue Book (legal ownership) at the time ?

He may drag his heel's when its time to transfer... that could be a minor future hassle for you.

However, you really have no need for further dealings with the new owner - the second hand car is sold as is.

Why do you want to know if the owner of the new car is his wife or girlfriend, what difference does it make?

The blue book is in the name of his wife already, the OP said that, so no worries about heel dragging "when it's time to transfer".

excuse my poor grammar. What I meant to say is that the blue book for the new car is in my girlfriend's name. We transferred the ownership of the new car to my girlfriend within a week of making the exchange. He must still be having problems selling the car I exchanged.

First of all stop thinking of back home - mentioning an accident - They would be the first ones to sell you s**t - Just like the car insurance companies do half a job whilst your out of town or dont have the right equipment (go figure is that my problem )

Not know what country you come from but it is Buyer Beware in most

Tell him you're not happy with the car he sold you and you're happy to accept your old car and the cash you paid back.

You'll never hear from him again.

Or change your SIM so he can't contact you again.

No money is owed and the deal has been completed.

He is calling her mobile daily with veiled threats of the police.

He is the owner or rentee of a large car tent in Bangkok who I would expect to be knowledgable about purchasing used cars, and the necessary vehicle checks and required diligence.

The problem is this is also causing discord between my girlfriend and I. You only have to whisper the police are coming to a thai and they wet themselves.

As I said change her SIM, problem solved.

But to be fair, now it's her car, she can do whatever she likes with it.

Sell it, give it away, or just drive off in it never to return.

Seriously man, people have lives. Not everyone is married to some girl that can change her number and lose contact with 10-30 years of friendship and business relation building.

OP says gf not wife, so not married.

I'm no great expert on Thais, but many of the ones I have encountered do seem to have the ability to relocate with no forwarding address at a moments notice.

Most Thais never actually tell anyone their real name. I've met several Leks, Noi, and a Jum, not their real names.

I believe a certain level of anonymity is the norm in most 3rd world countries. (developing if you insist)

How many Thais do you know, where you could write their name down if you needed the authorities to find them?

Maybe look inward at what kind of person you are if you only know these kind of people, i don't and most farangs i know also dont.

I'm the sort of person that employs servants. I also live in a Thai only area.

I try to avoid interacting socially with the locals, but one does need a certain level of contact with the cleaner, neighbors, delivery people, gardener, market vendors and local shop assistants. What kind of person am I ........ solitary. I don't want to talk or socialize with anyone. It makes Thailand almost perfect, they don't speak English, and I don't speak Thai, so I don't need any excuses, sorry, I don't understand.

Additionally, IF legally married and some legal issue arises which leads to possible debt etc the husband may also be held to account in some way.

Maybe a little mistake that the dealer saw a farang??. The dealer saw you and is now trying to make some extra baht. You must have signed a contract, or your gf?

I hope that your gf is trustworthy and the story is the way you see it. You made a deal and he can tell you a thousand times that he'll call the cops.

Turn the Speer around and call the cops that he's molesting you/gf on the phone and threatening you. If your gf's not on your side and tells you that you should better pay, then please ask yourself why she's acting like that.

Guy has no legal standing used cars are sold as seen in TH.

As long as you have the paperwork to show that he paid you and you gave him the car then change your GF mobile and move on.

There are used car inspection services in BK so im wondering if he later had the car inspected and it failed. Either way not your problem.
