An Australian judge was left so shaken by a paedophile's crimes that she walked out of court to delay sentencing and remove emotion from the punishment she will hand out.

 

Convicted child rapist Jason Daron Mizner was supposed to be sentenced in the Brisbane District Court on Tuesday but it was put off until Friday, AAP reported.

 

Justice Leanne Clare said she viewed part of one of the dozens of rape tapes and found it "very confronting", and needed a break to ensure a fair sentence. "I think it would be best to put some distance between the viewing of that tape and the delivery of the judgment so that it does not overwhelm the sentence," she said.

Yes, life without any chance of parole. If it was a motorcycle accident which caused this aberration, why wasn't it picked up sooner and treated? Conversely, he should have recognised what was happening to him and done the world a favour by topping himself. It's what I would do if I ever found myself ever wanting to harm a child.

Like what emotions? its like you woke this morning all new to this horrid case right? in anyway, judges has that penalty scale according to the committed crimes and offences and emotions has no place in the bench..

Mizner's lawyers argued his sentence should be reduced 

 

 

Sometimes, I think defence lawyer's ideas should also be questioned.

For what he has pleaded guilty to, there should be nothing other than the absolute maximum sentence given.

To request a reduction, for whatever reason, is beyond belief.

He is such a mentally deranged person-  I often wonder why castration isn’t the penalty for any first timer rapist to children ? For the pedophile will only do it again and again.

To argue for a reduced sentence because he had a bad time in prison before ......ridiculous. Nothing compared to the he horrific time the girl and her mother are going to have. 

Lets hope his time inside Prison this to e will be even worse.

I tend to agree... but for undisputed cases this is where I’m quite comfortable joining the ‘hang-em high’ crowd... 

 

Remove them from society with the death penalty. Human Rights, No! Some people give up their Human Rights when they behave this way.

Mentally unwell or otherwise - there is no mitigating circumstance...

Convicted pedophiles should be barred from leaving their home countries! So far I have encountered 3 people that were convicted pedophiles in their home countries and still managed to make it to Thailand and start working as teachers here, luckily all 3 of them have either been either put in Thai jail or been deported after the facts have surfaced, but sadly, they had all been here for several years before people around them started to ask the right questions. 1 problem is the Police clearance, today it's enough to have a Thai police clearance to get work and all the paper work done and to request a police clearance/report from the home country of someone else can many times be difficult... especially when the language barriers start blocking the way you are heading!    

These cases are not uncommon and often follow a pattern, a man Thai or Farang, befriends a woman to gain access to her child. Sometimes the mother is complicit or turns a blind eye due to a combination of poverty and culture.

19 years, he'll be lucky to make it through 3 in prison.  If his mental anguish was caused by prison, he's about to get a whole lots more now he's a pedo.

Defence Lawyers are a weird lot. Would you as a normal person not reach the point where you cant defend the Bastard anymore. They never do. Even take pride in getting the Guilty off.

Good to see a judge behaving this way. Justice cannot be an emotional reaction. 

 

Still hope this piece of filth gets life with no chance of parole, but kudos to the judge.

From a point of view of securing the sentence, the judge’s decision to delay before sentencing almost certainly provides a defence against a later claim of unfair treatment. 

 

So a wise move.

 

This does not detract from the harrowing experience she, the Police, jury and all those involved in the review of evidence and trial have had to go through.

 

A guy I worked with sat on the jury of a similar trial and wound up having a breakdown directly as a result of the evidence he saw and heared during the trial.

A dear friend who joined the police also had a breakdown after dealing with a crime of child abuse.

 

It’s easy to be critical of the police, courts, justice system but we should always keep in mind on a daily basis they deal with stuff the rest of us hope we never see, often with things we can’t even come to think about.

 

We really should be thankful to those who deal with these terrible crimes.

If the judge needs time to review the verdict because of her emotions, she absolutely is unsuitable for this case or maybe to be a judge at all.

She knows what he has done, he doesn't deny, so look in the lawbooks and give him the punishment as per the law.

Nothing emotional about that.

Not good, because obviously she can be influenced.

it is a shame that a judge can see that he is predatory, well organised and highly likely to offend again and yet she only gives him 19 years and he could be out in 13.  I don't understand why they would take into consideration the 11 years served in Thailand which was for a different crime, in a different country, whether or not he was 'tortured' as his defence would have you believe. You have to feel for the poor girl, who at about 13 now will be reliving this as this mess goes through the courts. It is probably damned good luck that he was caught originally in Thailand as he probably would have escalated to murder to cover up his crimes. Surely this is a case worthy of throwing away the key and incarcerating him for life to protect society from his future release. That poor girl will be in her 20's when this guy is coming up for parole. Shame on you Australian judge, you should have done more.

Of course I don't defend the perp.

But if the perp did already spend 11 years in prison for this, how is it possible he is on trial for the same thing for the second time?

2 different child rapes, 1 in Aus and 1 in thailand

Much misunderstanding here,  judges employ these ruses to negate the convicted's ability to appeal. 

 

It's not about not being able to separate emotion from  sentence, it's about neutering some shyster lawyer from saying it did.

Yes, after a couple of placed cuts to allow the agates to drop out and be exposed, then it's a choice between blow flies or ants.
