Judge temporarily halts release of tell-all book by Donald Trump's niece

NEW YORK (Reuters) - A New York judge on Tuesday temporarily blocked Donald Trump's niece from publishing a tell-all book that offers an unflattering portrait of the U.S. president and his family.

 

Justice Hal Greenwald of the state supreme court in Poughkeepsie, New York, issued a temporary restraining order against Mary Trump and her publisher Simon & Schuster at the request of Robert Trump, the president's brother.

 

Robert Trump has said the scheduled July 28 release of "Too Much and Never Enough: How My Family Created the World's Most Dangerous Man" would violate a confidentiality agreement tied to the estate of his father Fred Trump Sr, who died in 1999. Mary Trump is Fred Trump's granddaughter.

 

Mary Trump and Simon & Schuster appealed Greenwald's order less than 2-1/2 hours after it was issued.

 

Their lawyer Theodore Boutrous called Greenwald's order a "prior restraint on core political speech that flatly violates the First Amendment" of the U.S. Constitution.

 

"This book, which addresses matters of great public concern and importance about a sitting president in an election year, should not be suppressed even for one day," Boutrous added.

 

Charles Harder, a lawyer for Robert Trump, called the defendants' actions "truly reprehensible."

 

"Short of corrective action to immediately cease their egregious conduct, we will pursue this case to the very end," Harder added.

 

Greenwald's order blocks the distribution of Mary Trump's book until he decides whether to issue a formal injunction. A July 10 hearing is scheduled.

 

Simon & Schuster has said the book spotlights the Trump family's "dark history" to explain how Donald Trump "became the man who now threatens the world's health, economic security, and social fabric.

 

On June 20, a federal judge in Washington, D.C. rejected a White House request to block former national security adviser John Bolton from publishing a memoir critical of the president. 

 

The case is Trump v Trump et al, New York State Supreme Court, Dutchess County, No. 2020-51585.

Who pays for all this legal work Trump is doing? I hope its coming from his pocket. He has more court cases going than work for the American people.

Unless Mary Trump's book reveals top security details, or incites violence, there is no way to prevent publication given Prior Restraint and that pesky First Amendment.

 

No clue why they're even attempting this as it will only generate more interest, appeal, book sales, appearances, and expose DJT's indecent behavior towards his family to more people.

Yes. A New York state judge does not have power (jurisdiction) outside New York state. If books were already shipped to California, say, or Arkansas, they can legally be sold regardless of the restraining order. It would be good if the editor of the story (I blame editors more than reporters for the lousy state of journalism) had included information about where the printing plant(s) are located.

Maybe there's advance release copies already released in the US and/or abroad. 

 

Maybe this will lead to the book being available on the WWW and US courts cannot stop it.

Are you sure about that? I couldn't find any information confirming it. I did find this, though

According to the report, the Trump family is attempting to get in front of the matter by seeking a TRO before the book is physically printed and shipped to retailers. As such, the family is apparently hoping to avoid repeating the DOJ’s mistakes in the John Bolton case. In an eleventh-hour move, DOJ sought a TRO mere days before Bolton’s book was set to be published but after the book had already been shipped to distributors, journalists and bookstores.

barr tried to block bolton's book ostensibly for faux natsec concerns.

 

There is ABSOLUTELY no way the TRO will survive review. You can't block publication, unless you can prove that National Security is threatened.

 

Exposing the president as a treacherous family member who helped himself to the estate, and kept a sick nephew from getting medical coverage, hardly seems to threaten the country.

From the article on CNN website:

In a Tuesday evening affidavit, Simon & Schuster chief executive Jonathan Karp said that blocking the book from publication would "impose extraordinary economic harm" to the company.

Karp disclosed that Simon & Schuster had already printed approximately 75,000 copies of the book. Karp further said that it "no longer maintains control of the copies" that have been shipped to booksellers and online retailers.

Makes you wonder. Can whitehouse/republicins delay election? Does president decide he will run or does Republican Party decide who will run? 

 

IMHO Biden can beat trump but can he beat someone better from republican party? Biden seems a very weak choice.

It's Robert versus Mary. That's all Trump, Sr's money passed down.

 

I've a niece that was my favorite, yet, she seems to have turned on me as an adult.  I would not hold much belief that her tell all book is anything more than a money grab off her Uncle's upcoming election.
