In her original complaint it states (at 9.) Ms. Carroll is a journalist.

Witness Lisa Birnbach was a journalist

Witness Carol Martin was a TV journalist.

 

And yet, at the time of the alleged offense, not one of the 3 journalists made contemporaneous written notes of the exact date of the alleged incident or when Ms. Carroll told the 2 witnesses about the incident.

 

All 3 can remember minutia of the incident or the phone calls or other conversations -- just not the the dates involved.


The complaint itself as per the exact time of the event only states: 

18. One evening between the fall of 1995 and the spring of 1996 ... 

 

Reminds of "A long time ago in a galaxy far, far away ..."

No surprises here.

 

Trump turns down his last chance to testify.

 

The judge had wisely offered an extension to Trump to confirm his intent to testify, that extension expired last night.

 

Good luck taking the argument you weren’t allowed to testify to appeal Donny.

 

It will of course play well to his dwindling base, but they aren’t going to decide the next election.

This is a lower burden of proof compared with a criminal case, which demands that jurors find a defendant guilty only if his guilt is proved “beyond a reasonable doubt.” But there has been no physical evidence presented in the case. Carroll has said she cannot remember the exact date of the alleged assault, which means that Trump can neither provide an alibi nor have his whereabouts called into question.

Does anyone know if the New York City trust fund man baby has returned yet?apperantly he missed the window to personally respond to the rape accusations wonder why……….oh and when can we expect a judgement

she presented a dress with someones dna on it and they requested trump provide a sample which if it never happened why would he not comply and it would have cleared him completely and lawsuit dropped...but trump refused to provide a sample...gee wonder if little donnie maybe did remember blowing a load in a dressing room long ago.....only guilty people take the fifth and only guilty people fear a dna test.....

The DNA sample on the dress was not a sperm sample.

 

The 5th amendment against self-incrimination is for criminal offenses.

dna is dna...  could come from sperm could come from saliva or whatever but if he never was in contact with the woman that what's the problem?   simple sample no match game over.

 

.trump is the one that said over and over only guilty people plead the fifth...no not a criminal case but presenting NO defense is pretty darn close to pleading the fifth.......his filmed deposition was a disaster (not my type but yes that is my wife?)  and i would guess his attorney begged him not to show up and dig the hole even deeper in person in front of a jury....get out the checkbook donnie and be glad that it is only a civil trial....

Per Judge Kaplan's ruling on DNA:

 

(Judge) Kaplan also questioned how worthwhile the evidence would be, noting there is no evidence of any sperm cells on the dress. So even if there were a match, "it would not prove or disprove Ms. Carroll's rape allegation," he said. And if there were no match, it "would not disprove Ms. Carroll's accusation."

 

"The alleged rape could have occurred without a sufficient quantity or quality of Mr. Trump's DNA to have remained on the dress since the mid-1990s," (Judge Kaplan) noted.

If Carroll were making it up, and gave a date say April 10, 1996, Trump may have records that on April 10, 1996 he was opening a new hotel in Rio de Janeiro and here he is in the local newspaper. So the psycho-excuses as to why Ms. Carroll "can't pin down the date" are consistent with making it up.

Grab him by the p trump has shown a pattern. This alleged rape is the tip of the iceberg. The season of his reckoning has finally arrived.

Some truly brilliant testimony from Trump in his deposition. Which the jury saw.

When asked to defend his comments about attacking women he said

"Historically, that's true with stars," he said in a newly released video when asked about the 2005 tape....

Kaplan then asked Trump whether he considered himself to be a star. Trump replied, "I think you can say that, yeah."

It is going to be hard to rule on the rape charge. Given there were no witnesses, no date for the offense, no medical records. How was Trump to defend himself with any kind of alibi when the date of the crime can't be determined? 

 

He certainly didnt do himself any favors in his deposition. Just his ego talking as usual. But however much you despise him, getting a judgement will be hard.

Definitely not a good day for Trump but he wasn't convicted of anything. This was a civil trial.

How about -- judged to be a rapist by a jury in a civil trial. Do Americans really want a man judged to be a rapist as president?

I hate to look like I'm defending but they didn't find that he committed rape. Sexual abuse and defamation, but not rape.
