Srikcir Posted October 13, 2023 Posted October 13, 2023 It looks like the defendant was convicted under TITLE II, OFFENCE RELATING TO PUBLIC ADMINISTRATION - Chapter 2, Malfeasance in Office, Section 154 of the Penal Code: Whoever, being an official having the duty, or professing to have the duty of collecting or checking taxes, duties, fees or any other money, dishonestly collects or fails to collect such taxes, duties, fees or money, or does any act or does not do any act in order that the person having the duty to pay such taxes, duties or fees shall not have to pay them, or pay less than what such person has to pay, shall be punished with imprisonment of five to twenty years, or imprisonment for life and fine of two thousand to forty thousand Baht. (my bold emphasis). This is the only section out of twenty sections in this Chapter that convicted gets more than twenty years, considering fifty years as life. But a literal reading of Section 154 doesn't seem to fit the punishment based solely on inappropriate use of a government vehicle. Unless otherwise the defendant was convicted of violation of multiple sections under this Chapter and imprisonment was cumulative (vs concurrent), ie., two twenty year terms plus one ten year term. The other nineteen sections are very descriptive in the punishment. For example (and maybe more on point): Section 147 Whoever, being an official having the duty of purchasing, manufacturing, managing or keeping any thing, dishonestly misappropriates the same for his own or the other person, or dishonestly allows the other person to misappropriate the same, shall be punished with imprisonment of five to twenty years or imprisonment for life, and fine of two thousand to forty thousand Baht. (my bold emphasis) It's not unheard of that after sentencing in Thailand, that if the defendant then confesses to the crime(s), the court will lower the sentencing time.
SingAPorn Posted October 13, 2023 Posted October 13, 2023 Somebody did not get his monthly brown enveloppe it seems ?

thailand49 Posted October 13, 2023 Posted October 13, 2023 When you hear stories like this it is tough not to comment " bashing " Thais because they got no shame in bragging how tough they are on crime when it is opposite " 50 years " every MP Senator must be rolling on the ground. Truly the Land of Stupidity!
Skeptic7 Posted October 13, 2023 Posted October 13, 2023 This place never fails achieving new levels of absurdity, even when it seems impossible to go any further. 1

mikeymike100 Posted October 13, 2023 Posted October 13, 2023 In 'normal' countries this would be a fine, only in LOS would anyone get 50 years, just proves the judiciary are a joke! 2
crazykopite Posted October 13, 2023 Posted October 13, 2023 Call in sick and get airlifted to the police hospital by helicopter 1
Andycoops Posted October 13, 2023 Posted October 13, 2023 The total absurdity of the Thai judiciary exposed for all its hypocrisy. I know of a guy in the next village who is doing 9 years for murder, go figure out that and the loss of a life with using a car for 2 years.. 1 1
2long Posted October 13, 2023 Posted October 13, 2023 Initially sentenced to 105 years, which is far more appropriate in my opinion! ???????????????????? 1
JeffersLos Posted October 13, 2023 Posted October 13, 2023 Then used it to drive himself to his large house after being granted bail?
ignore it Posted October 13, 2023 Posted October 13, 2023 That's what happens when you decriminalize golf.
BE88 Posted October 13, 2023 Posted October 13, 2023 Nooooo, it's just a typo, it should read 50 days, but we know that the secretary who wrote the report had smoked something wrong 2

twizzian Posted October 13, 2023 Posted October 13, 2023 I think the judge calculated the age of that old crate and sentenced him accordingly.

Don't forget the Dutch guy who got 103 years for money laundering. His house on Phoenix Gold Course is a derelict since the govt commandeered it. The land must be worth a pretty penny though. Wonder who now owns the chanote?

Chris Daley Posted October 13, 2023 Posted October 13, 2023 I would just paint the car pink and let him carry on.
Bepah umayun Posted October 13, 2023 Posted October 13, 2023 some sort of misunderstanding here, maybe.
Cabradelmar Posted October 13, 2023 Posted October 13, 2023 The rule of law gone off the rails again... What, did they think they where making up for all the other "free walks" by making one big nonsense prison sentence? Thai-dumb (logic).
Bangkok Barry Posted October 13, 2023 Posted October 13, 2023 4 hours ago, rwill said: I guess he didn't confess to it. Read the link. A total of 21 counts of Rungrak’s convicted misconduct initially handed him a jail sentence of 105 years which was curtailed to 52 years and six months due to confession made by the defendant and finally cut down to a maximum of 50 years. So, he got off lightly 2
