Immigration American Man Arrested for 388-Day Overstay in Sri Sa Ket

Looked it up on Google, hardly a resort. More like long term cheap housing in some godforsaken corner of Thailand.

I see numerous reports of overstays like this involving individuals from various nations. Why do you think they do this?
- Do they have something in their records that would prohibit them from getting a proper O visa and receiving a long-term stay extension?

- Is the process so confusing that they don't try to learn how to do it?

- Are they just too lazy to do it?

From my understanding speaking to such folk, laziness, cantbearsediness and lack of funds. I can kind of see the attraction. If you struggle to meet a visa condition and skip it, seems very easy to just fall between the cracks and never bother again if you dont interact with any govt agency.

The common sense point I believe UK was making was... in a time when the country is bemoaning the lack of tourists and their spending to the country, it makes ZERO sense for a landlord of all people to grass out a paying tenant (and thus lose that tenant) to Thai Immigration -- unless there were some broader/underlying issues going on with his tenancy.

He overstayed his visa which is not a criminal offense in most sensible countries.,. there can be any number of reasons a person overstays a visa and it does not mean they have a criminal record.

Guest must have gotten on the wrong foot with resort owner. No more payment maybe? Thais are known to be ‘benevolent and turn a blind eye to any infringement of laws.

On 27th June, Sri Sa Ket immigration authorities arrested 52-year-old American citizen Mitchell O'Brien Dinino, who was found residing at Kriskanya Resort in Phayu, Sri Sa Ket, overstaying his visa by 388 days.

 

The operation took place at 4:00 PM after the resort owner reported the suspiciously prolonged stay of the foreign guest.

 

Officials then verified the overstay through the immigration information and biometric systems.

Led by Pol Maj Gen Waris Sirip, Commander of Immigration Division 4, the operation involved Sri Sa Ket immigration police, Phayu Police Station, and related agencies.

 

This coordinated effort confirmed that Dinino had exceeded his permitted stay, leading to his arrest and handover to Phayu Police Station for legal action.

Pol Maj Gen Waris Sirip highlighted the ongoing focus on enforcing immigration laws under national directives to prevent issues such as overstays, illegal entry, and unauthorised work.

 

Emphasising a proactive approach, he called for strict checks on travellers and close collaboration with local authorities to protect the safety and security of both residents and tourists.

 

This arrest underscores the commitment of law enforcement agencies to maintain order and uphold immigration regulations across the region.

I think i saw him when i passed through phayu a month or so back. He stood out as he was dressed differently walking along the side of the road  towards where that resort is. 

 

I thought he was some sort of pilgrim as he was dressed in white,  carrying a shepherds crook and wearing a straw hat wrapped with flowers.

I am the last person to have automatic respect for a countries laws, of course I will respect anyone's laws if in my opinion they are fair.

Let me put it this way. When I came to Thailand to stay, I was required to go to the border every 90 days for a stamp in my passport. I did due diligence and saw that this was a fair way of staying in the country, I did that for a couple of years and then was a school teacher for a few more years.

So I did everything legally and had a work permit. So when that finished I thought I could go back to the way things were when I first came to stay in Thailand. No chance, of course I could put 800,000Bt in one of my bank accounts, but I did not agree with that, so I had to go to an agent 500 Ks away in Pattaya to get sorted out , of course this came at a price.

Compare that to when I first came to live in Thailand a few years previous, better still compare then to now when I have to make regular runs to pay an agent, do 90 days reports. Is it any wonder I have no respect for Thailand or some of their laws.

It is so, so different to when I came here 20 years ago, and very much for the worse.

Quite, Thailand is a progressive country when dealing with illegal immigrants. UK is piling up it's own funeral pyre doing nothing to stop thousands a week pouring in costing 8 million a day. Which country is more sensible, the one looking after it's citizens or the one bankrupting them?
