Clearly he was provoked by the girl grabbing him and then lost his composure. His overly forceful push sent the girl to the floor and this really triggered her then.

 

 

It's hardly excellent self-control if he pushes a girl to the floor so forcefully that he was lucky he didn't seriously injure her.

 

It's this one use of excessive force against her which would invalidate any self-defence claim and ensure he's convicted of assault.

 

The girl too is guilty of assault, as she slaps the defeated Swede when he kneels on all fours repeatedly.

 

 

We all know women in Thailand can fly into a rage easily. Which  is why it is such a fail to also lose your composure as the Swede did.  He should have removed the arm holding on to him, not push her to the floor hard, but he lost his composure and became aggressive. He was provoked, but it's no excuse.

We all know what kind of females are hanging around Pattaya's bar scene with the same kind of Thais around just waiting to find an excuse to beat up a foreigner.

Great advertisement for Thai Tourism! There are certainly different ways to handle a disagreement, but in a trashy environment you cant expect too much, and it seems to get worse every year!

Maybe it's not that black and white and if it ever went to court, opposing legal teams would be arguing the case with the judge and they would be playing the tape over and over in slow motion.

Well, if you look at the beginning of the video and focus on the Swede's left arm you'll see a pushing motion of the left arm, which goes towards the girl. Then he retracts the arm quicky. The timing and the force of the arm movement correspond exactly with the timing and force of the girl's fall.

 

No doubt  the judge would find the girl was pushed violently to the ground by the Swede.

Something similar happened in another incident. I just watched a crime. One guy was beating someone up. Someone jumped in to interfere and put him in a headlock. And he died. The judge ruled that excessive force was not intentional. He was merely trying to subdue the guy.

He was very lucky. There are many cases where excessive force resulted in serious convictions and self-defence was rejected.

 

Even when burglars intruded in a home there's a case where someone shot them and was then handed a murder conviction for excessive force.

Yeah so it's at the discretion of the judge. It's not black or white.

And depends how good your lawyer is.

Well, as my constitutional law professor said : "If we knew what the law is, we wouldn't need lawyers to explain it to us". So obviously the judges don't have total discretion because they have to follow the law, but clearly they have ability to interpet the law in a way they think is the most just.

Nah, judges are also emotional creatures.

And that might make the difference between a leniant and harsher sentence.

The laws are vague enough to allow human beings to play with them a little. 

 

In a case like this, their entire relationship history might be brought out.

And if he slept with 1000 hookers or if she was in the habit of trying to murder him with a cleaver in the kitchen, it will all come into play in the final verdict.

He was attacked by a random gang of Thai guys.

Unless they were policemen, and used due force, his relationship with a Thai hooker is nothing to do with the attack or the court action.

Actually, the Thai guys can claim "self defence" as in law you are allowed to defend another as you would defend yourself, so the relationship fight between the two could be relevant as the Swede appeared to shove her to the ground. 

 

This could have given grounds for the Thai guys to intervene to defend the girl.

She's trying to wrench his left arm from his head.

He either slips, or just lets his left arm go, and backwards she calls, because she's off balance and using all her weight to pull his arm... 

 

It only 'looks like a push'  (to some) because of his arm movement, but thats just because he's let his arm go free rather than resisting her....

 

His arm is only lowered because she managed to wrench it free from his head, but in doing so lost her purchase of his arm and her balance. 

 

His other had remains on his head - I'm guessing if he wanted to push her, he might have done so with both hands. He was being very defensive, she slipped...

Yes, but that's when another person is in mortal danger or attempted murder or serious injury. Local and tourist - the law is the same.
 

You're overprotecting Thais, it's visible even from the moon.

For some reason you don't remember how recently Thais in Pattaya like to kick foreigners lying on the ground and exhausted on the head with all their might. At least three cases in the last 6-12 months. This is what was caught on private cameras and became publicly known. And now the guards have come up with a way to hide it by demanding that these videos be deleted on the spot.

That is true, and in this case the girl too was in fact slapping the Swede repeatedly as he was down. Hence, she too should have faced charges for assault.

And the girl didn't fall hard. It was just a light fall. And in general, people often fall, because they usually stand on two legs. Yes, sometimes you can break your head from a fall and die, but these are extremely rare cases, 1 in 100-1000.

It's another matter when a crowd pounces on you and kicks you with all their might while you're lying on the ground.

Truth is ... In a normal civilized society, the people around you should have separated them and called the police.

When the locals are full of hatred for a foreigner and are looking for any excuse to pounce on him in a crowd, that's different, this is a Family Resort.

She didn't fall because she "stands on two legs". She fell because of the Swede, who pushed her to the floor.

 

If people see a woman being pushed to the floor and hitting the floor, it is normal for men to come to her aid. If an English woman were pushed to the floor in the UK by an Albanian no doubt English guys would come to assist her. It's very normal.

Regardless of . .  ‘if’ . . he did something to offend someone, it should be dealt with by cops not a mob of Thai’s just out for a bashing a foreigner. This kind of behaviour is destroying Thailand’s friendly image of the land of smiles. . . with all the bashings on here and social media, most tourists don’t see it as a safe place to visit anymore. Just let the cops deal with him and and deport any trouble makers and let Thailand become The Land Of Smiles again.

Then again, there is the  problem of tourists getting excessively drunk and belligerent and abusing the locals.
