Taxes and fees for selling land in Thailand

Sorry if this has been asked before. My wife (Thai national) is selling her land in Hua Hin. She has owned the land for 10 years. The selling price tentatively agreed is 9 mil. Could someone clarify the cost selling ie transfer,stamp duty and tax. Are the fees and taxes based on the land office figures or the actual selling price? I have seen conflicting information on the Internet.

The taxes are based on whatever figure is highest. The land office has an appraised value that you cant go below, and if you disclose a higher sales figure then that's what will be taxed.

Its amazing, but all properties seem to change hands for the land office appraised figure.

The tax is based on, if you have been using the land as home – i.e., house book with owner's name – or business. You'll need to know both selling price and the land office's appraised value.

OP, go to the land office website or one of the online legal websites that will tell what the fees are. However some of them are often subject to negotiation between you and the buyer who pays what. I have it all in my files somewhere so let me know if you need more. 

I think it is 2% transfer tax, 0.5% stamp tax, plus maybe small paperwork fee, <200 (?)  

 

Since owned more than 5 yrs, no business tax.

If it has a chanote you can get the appraised value online. It's all in Thai, so I'm assuming your wife will need to navigate it.

On a mobile you tap the three dots at the bottom right and select current location while you are on the plot of land. It takes a while to do do its thing but should zoom in to your location and show all the plots of land. Double tap the plot you are interested in an the appraised value will come up.
