SRT Postpones Legal Complaint to DSI Over Land Encroachment

The State Railway of Thailand (SRT) has unexpectedly postponed filing a criminal complaint with the Department of Special Investigation (DSI) over alleged land encroachment at Khao Kradong in Buriram province.

SRT’s legal team had been scheduled to lodge complaint No. 97/2568 with DSI investigators on Thursday, 4 September, at 14:00. The case concerns alleged unlawful occupation and issuance of land documents on railway-owned land in Samet and Isan subdistricts of Mueang Buriram. The complaint was to name private individuals, SRT officials and other state officers alleged to be complicit in the occupation.

However, on the day, SRT informed DSI that it would postpone the submission without giving any reason and without setting a new date.

The delay comes after DSI’s own investigation found that certain SRT officials were directly involved in the encroachment. The agency subsequently wrote to SRT, instructing it to lodge a complaint in its capacity as the injured party. Instead, SRT requested a postponement.

According to DSI sources, investigators have already gathered substantial evidence and notified the relevant parties of the damage. Normally, if a complaint is not filed by the affected state agency, the DSI Director-General cannot formally register the matter as a special case. However, past court rulings and Council of State interpretations have confirmed that other state agencies may step in to file a complaint during an investigation.

If SRT continues to delay, the agency may be deemed to be neglecting its duty. DSI has stated it will issue another letter urging SRT to proceed with the complaint.

If you were the governor of SRT, what would you do?

If I were head of SRT I would progress the case through the proper legal channels.
