hello first i would like to say how helpfull this forum is, and i wonder if someone could help me.

i am 33 from england i have just married my thai wife and need to get a visa to stay in thailand. i understand i need the no imm visa type o.

i thought i would have to marry first (which i could only do in thailand) before applying for the visa, but now i am in thailand the information i get from the internet says i can only apply from england before i entered thailand, catch 22 ?

does anyone know if or how i can apply for the visa in thailand

at the moment i am on the visa ex 30 day rule which i understand i can only 3 times.

Do you and/or wife have 40k monthly income that can be proven with tax payments for at least 3 months or Embassy letter? That would allow issue of single entry non immigrant O visa at 2,000 baht followed by one year extension of stay at 1,900 baht. Failing that you will have to obtain a visa outside of Thailand.

You can only stay 90 days in a six month period using visa exempt. If you had entered with a tourist visa you would have more options. You should be able to obtain a non immigrant O visa from Malaysia/Laos or Singapore with marriage certificate/copy and copy of wife ID card - if you use Penang you may be able to obtain a multi entry valid for one year but should have some bank account information to show. In Singapore it would probably require 400k baht at current exchange rate somewhere in a bank account to obtain.

You can research a little farther into the forum for details, but others have reported getting "O" visa's in Penang, KL, and Singapore. Once you have that visa, and if you qualify, you can ask for an "extension of stay" within Thailand. With that, you can stay for a year, doing 90 day address reports.

Thanks for the extra details, Lopburi.

Would like to modify my original post as the current change visa information on immigration web site makes no mention of a need for money so you might want to check out obtaining a 90 day stay non immigrant O visa at the 2,000 baht cost with wife and these items (if you meet the 21 days remaining on your current stay) using TM.87:

DOCUMENTS TO BE SUBMITTED IN SUPPORT OF THE APPLICATION FOR VISA OR VISA STATUS ALTERATION (NON-O): FOR A FAMILY MEMBER OF A THAI (APPLICABLE ONLY PARENTS, SPOUSE OR CHILD.

In case of no children, the application must be submitted 21 days before visa expiration and Overstaying in Thailand, application could not be submitted

That is also possible, but probably best to keep in reserve in case of emergency. He seems to be looking for a long term visa/extension but without any details on situation we are shooting in the dark.

thank you all i feel much better reading your replys

i entered under the 30 day exemption rule in september and have renewed once crossing to loas. i have until the 10th oct, then 30days after that for the final stamp.

at presant we do not have 40k monthly income but do have money enough in the bank to prove able to stay, we have 2 children (by my wife first marriage).

so it seems that i can get the non imm visa 0 so long as they do not require the 40k a month income. i will try to get from bangkok if i can first before having to travel to penang or loas.

is it the thai royal consalate bangkok i need to contact?

There is no Thai Consulate inside Thailand - inside Thailand you obtain extensions of stay for one year but you do not qualify for that without the 40k monthly family income. So you will need to go to Penang, Malaysia to apply at the Royal Thai Consulate General there and you will want a multi entry non immigrant O visa. Take photos, your marriage certificate/copy, wife ID card copy (signed and dated) and some proof of bank account with you. It is also good to have copy of home register of wife and a short letter from her inviting them to issue that visa to you so you can visit her. The last two probably will not be required but best to have. If wife travels with you she could write note there if required. This visa will allow you to enter for up to 90 days an unlimited number of times during a one year period; so can cover up to almost 15 months.

thank you so much lopburi3 that has helped me a lot, now i know i will go to penang

i presume it is ok to show a uk bank acount in my name as proof, i do not need to get a thai account

although its no problem to get one.

Singapore has (or had) a policy of account anywhere but had 400k requirement. Penang does not seem to have an amount requirement but have not seen any report of using account outside Thailand there. I would set up an account; even a joint account should work. But even if you don't have it is worth a try - at this point it just seems like added insurance of multi entry issue.

I thoght you had to be aged 50+ for the 'no imm visa type o'.

Am I wrong on this?

Thanks

Iain

No need to be 50 for the "O" visa, it can be issued for marriage or other reasons to visit Thailand. An "O-A" visa is different and is issued for retirement purposes for those 50 or older.

A question to the forum on what I think is a related topic?

Has anyone knowledge or experience of Immigration requesting or demanding that a foreigner (over the age of 50) apply for an extension of stay based on marriage to a Thai spouse rather than based on retirement "IF" the retirement option is what the foreigner is seeking?

The way my funds are set up in my own country, I will find it much easier to maintain the 800,000 in the bank (and 3 months before renewal), rather than going through this monthly combined income test of 40,000 and the associated extra paperwork.

Also, one of my reasons for asking this is I"m as confident as anyone can be these days of a continuing good marriage, but I'm also 'fairly' sure I've seen on this forum in the past, horror stories of Mr Farang being given 7 days to leave the kingdom and everything behind in the case of marriage breakdown with little chance of being able to switch to a stay on retirement grounds.

Posted

They have always preferred you use the retirement option if it is available. Much less work for Immigration that way. So don't believe anyone has been told that.

As for change from family to retirement, your wife would have to sign her knowledge of the change but it is an easy change other than that extra paperwork requirement.

Thanks lopburi3;

This won't be a change as such at this stage, as at present I've only entered on Tourist Visa's and am soon going to go down the path of the O-A followed by extensions.

I asume you are aware that the 0-A Visa is only obtainable from a Thai Embassy in your home country.

Section 7.23 of the Immigration change made in October last year allows a 60 day one time (only) extension of stay for those visiting Thai spouse or child.

7.23 In case of entering for

visiting a Thai wife /

husband or child.

The permission shall be

granted only one time with

the granted period not

exceeding 60 days.

1. Application form

2. Copy of applicant’s passport

3. Copy of census registration

4. Copy of the Thai national’s ID Card

5. Copy of marriage certificate or birth

Lopburi, as usual, you deserve a pat on the back for your vast knowledge of current up to date visa information, now with regards to my situation I am currently on a 30day exemption, as mentioned previously We will be marrying in November, the question I ask being, would it be possible to enquire as to a 60day extension after marrying in Bangkok (on a 30day exemption)? I am guessing not, as the ideal route would be a non o application in neighbouring countries with documentation to support, but if I can get the 60 day it would assist my timescale immensely.

Thanks again for your help with all of our visa queries!

Regards, DSG

As the 30 day stamp is not a visa is is unlikely but would be worth asking if your really want it. If you can only receive a single entry non immigrant O visa the first time you should be able to make that entry good for another 60 days if you use it then.

Thanks Lite Beer

Re "O" application in one's home country, did realize that and will do in Melbourne.

Thai Consulate here excellent, friendly and helpful.

Sorry F S but you did state O-A Visa , not the same as O Visa.

O-A In you home country.

O Can be obtained in a country neighbouring Thailand.

hello again

after reading the requirements for 40,000 bhat in thai bank requirement for the non imm visa o

i was confused becuase some people said 40,000 bhat a month income (which i do not have in thai) and some talk of 400,000bhat in the thai bank which i could get.i rang thai immigration and was told now they only except 40,000 a month income,i would like to know if some consulate outside thai still except the 400,000bhat in bank as some people talk.

as for now i am going to go for the 60 day visiting my thai wife and children option, but i need to stay 90 days

so what can i do after the 60 days? i can only apply once? after that i would need the non imm visa o but would need 40,000 bhat a month? i take it that is why so have to have a not real company so they can pay themselves 40k a month? sorry i am still confused, as many i am still new to visa's.

1. Extensions of stay (one year) from Immigration require proof of 40k per month family income.

2. Single entry non immigrant visas for 90 day visits are normally available at Consulates with marriage certificate and copy of spouse ID card.

3. Some Consulates will issue multi entry non immigrant O visa valid for one year with para 2 documents and proof of financial means (Singapore 400k in a bank account) (Penang may issue without but seems to want to see some kind of Thai bank account - amount on deposit not specified).

for me vientiane is easy to travel but penang may be better, thanks again
