Not exactly the actions of a contrite guard - the apology? What do you expect when you're surrounded by police and confronted by the angry mother of the victim? He was hardly likely to ignore her. On the other hand fabie, the paymaster and dozens of his cronies and leeches have raped this country and not one of them has made the slightest indication of remorse or has apologized.

Well, you did say he had fortitude which is defined as having the courage to face pain or adversity, which makes out that he is the victim here. I take exception to that and explained my thoughts on the matter describing him as hardly being contrite. No you didn't say contrite nor did I imply that you did.

And yes I did miss where he had apologised to the army colonel in hospital as it wasn't mentioned in the Khaosod OP I read and presumed you were referring to.

Why did it take so long? Even if the army officer did not press charges, carrying and using a firearm to shoot someone, as well as giving someone a beating, should be enough to land the perpetrator in jail. So many times, I just have to scratch my head and remind myself that This is Thailand and they don't do things the way they do back home. Oh, well, at least he is off the street for now; not that there aren't many more just like him.

Guess you've never lived in Thailand. Bangkok is not Thailand. People move around. You have a lot of people who've never been five miles from home (well, not anymore, make that twenty-five miles). You have a lot of other people who move around a lot. "Hey, seen Somchai lately?" "Aw, he said he was going to Surin, or maybe it was Ranong. Wait around, maybe he'll come back." "I have an address for a person I'm trying to locate, can you tell me where it is?" "Never heard of it." Incidentally, the same thing happens in Western countries. It can take police months to locate a suspect or a witness.

The police, in this country, can arrest whomever they want to, whenever they want to. Two examples:

In the first instance, the suspect was being hidden at a home in Surat Thani. He is not from Surat Thani. In the second instance, there was no identification of the perpetrator despite a video tape and Bt. 500,000 reward. The first instance was an attacker on the Red Shirts (no one died) and the second instance was an attacker on the anti-Yingluck government (one dead, 24 injured). The police being notoriously biased, in favor of former Pol. Lt. Col. Thaksin Shinawatra, tells me that an attack on an officer, of the same military that overthrew the illegal government of Thaksin Shinawatra in 2006, was not an important case to pursue. This man was not hiding, he was a PCAD guard and he could have been arrested at the hospital or at the protest site at any time before the coup. IMO, the police would have not acted without being prodded by the NCPO. Now, my question to you is: Why are you making lame excuses for the police?

It seems the good army colonel was not in uniform and the beating stopped when his military ID was found in his car. The army is just now forcing the police to take action.

Chooka doesn't say it will make the charges go away. There isn't anything to say he thought it would make any difference at all but I think Chooka is making a general comment about this practice. The only reason I wrote what I wrote is that the prosecutor has the duty to make clear without doubt that the accused did what he allegedly did and the defense council has the task to shed doubts on what can be alleged.

When within two months we get rather different stories that certainly doesn't help. The charged guard might still get sentenced to some jail time, but the more stories start to differ the less he'll get.

Come on rubl. This is the first time you heard about being dragged to an empty building? I can't imagine why you would post such a comment unless you wanted to cast doubt on the reporting, or more likely, the statement made by the mother.

Ignoring that subtle attempt of distraction let's have a look at your first link;

OK, so he's near shelter, which happens to be the RTAF HQ. What do you think the chances of there being an empty building near the RTAF HQ where he was dragged into by the PCAD thugs when they caught up with him and then proceeded to beat him up? Feasible, yes?

these thugs rush forward (towards the "shelter" that the Colonel was running to) and beat him up - no mention of being dragged into a building but that description is provided by the brother of the attacked colonel and he was not there at the time. This is his recollection of the events presumably told to him by the victim. It was the first reporting of the incident and by a third party , not the person who was there so quite conceivably is not an absolute verbatim account.

Again, the events as stated by a third party, but I have no problem with accepting that a bunch of PCAD thugs were beating up the Colonel whilst others searched his car and found his ID. I don't see any contradiction between the English translation of the event in two different articles, the accounts of which no doubt were conducted entirely in Thai.

Once again I wonder about your motives for posting your "doubts" about this article.

My dear fabs, I don't post doubts, I post statements made before by the victims brother and by his mother.

I'm sure the council for the defense will use these different stories told freely by relatives of the victim to shed doubt on what actually happened. There were also statements that the colonel may have behaved as intoxicated.

I'm not trying to get the accused guard off, neither the others who helped him, but seem to have left the picture somehow, no I'm just trying to explain that when the mother of the victim comes with two different stories within the span of two months, the court may justly decide to ignore her statements or even allow the defence to use it to shed doubt on actual happenings.

Personally I think this accused assuming he's the correct accused should be punished as defined by law.

For one I'm not a mod, not even a pseudo mod. Furthermore, I logged in and only started reading when BB had made his reply and EL already replied on that. Do you think I should have made two separate replies?

BTW since you're so curious, do you perhaps know if the 'statute on limitations' applies on sentences which can't be executed because the sentenced has jumped bail and seems a bit afraid to return without a full and blanket amnesty?

PS a bit of topic, butsince you raised the issue, is there a statute of limitation applicable to sentences? I thought it only applied to cases for which the accused cannot be charged because he's not 'available' to be charged?

Not beyond the realm of possibility that Taksin will return in 2017 with the intention of fighting the 5 cases. You know better that the arrest warrants really mean nothing in Thailand. Just how many politicians are charged and have arrest warrants, out on bail and walking free. Taksin complete silence since the coup may have some significance to his return.

My Dad likes to tells his students that an appeal on a test grade can be a two way street.

Wasn't thinking of the Amnesty Bill, to be honest - more about playing with things pertaining to statute of limitations expiry.

Either shortening or prolonging it shouldn't be that hard, legally. Can easily enough be masked a regular sort of change.
