rooster59 Posted September 23, 2017 Posted September 23, 2017 18 Chiang Mai resorts examined for suspected encroachment A team of officials on Saturday (Sept 23) examined 18 resorts in Chiang Mai province to find out if they have encroached on Mae Tha Chang and Mae Khanin forest reserves. The team, comprising military, police and administrative officials and local leaders, was was led by Cholathis Suraswadi, director-general of the Royal Forest Department. Mr Cholathis said in the team found 18 resorts and other constructions in a total of about 144 rai land suspected to have encroached on Mae Tha Chang and Mae Khanin forest reserves in tambon Nam Phrae of Hang Dong district, the authorities. Tonto21 Posted September 24, 2017 Posted September 24, 2017 I don’t pretend to understand all the law regarding land ownership or claiming land in Thailand…. Like most laws in Thailand it is very complicated. What I do know is the laws in place regarding people just grabbing land is a good one. It’s aim is to stop Unscrupulous individual or companies grabbing land, sitting on it and after a given amount of time, applying for ownership, which is doable if you are Thai and going to use for your own use, (not for commercial use) No in all areas. The whole law is about keeping the price of land down and affordable and obtainable for the poor….. These companies drive the price of land up and force the poor out of the areas. The problem is corruption, the man that’s paid to look away is not always the man for long.
rebo Posted September 24, 2017 Posted September 24, 2017 Cycling around in Nam Phrae forests since about 10 years almost daily my MTB companions and I can observe clearly the “development” of former woodlands to (mostly huge) barbed wired areas still with open access sections to closing these after some years to erect walls so high that you can’t have a look what goes on inside to build concrete roads to access them comfortably, and one day, when you peer over the wall you see big residences surrounded by lawns, garden and gazebos ...I can’t say if this happens legally or not but it’s obvious for us that some seemingly already rich individuals take more and more control over former pure forest land. And it doesn't look right.

Aah, this is following the usual line of defence, "But I have the corect papers". The question is how were these papers issued? And the answer is usualy a very hefty bung in the right direction.

rudi49jr Posted September 24, 2017 Posted September 24, 2017 Just follow the money, find out where all the brown envelopes went; millions and millions of Baht must have been paid in bribes to several people high up to make this possible. You simply can not build 18 resorts (is this just the tip of the iceberg? how many more illegal resorts are there?) in protected areas without handing over many fat brown envelopes to a whole lot of people in power.

I can't see any other reason that these developments have flourished for so long. Probably bribes all this time, and now, some NGO is leaning on the government to preserve their preserves...

In the west, if you buy land, it's got to be run through a title search, and you would soon find out that you are encroaching on national park land. Either that isn't the process in Thailand, or these are all squatters...
