The recent changes to the requirements for a retirement extension require 800k baht to be locked in an account for 5 months and 400K locked in all year.

 

In the past the rationale for the 800K requirement provided by the Thai authorities was that it was to cover the expat's living expenses.

 

That rationale however, no longer holds up to logical scrutiny.

 

If the money cannot be touched, then how can one use it for living expenses.

 

So the reality is that in addition to the 800K held in a Thai bank, a retiree will also have to bring in additional money to meet his or her living expenses.

 

So in practice this new police order has effectively doubled the money required to apply for, and comply with the conditions attached to, a retirement extension.

 

Some years back under the Taksin regime the financial requirement to apply for a retirement extension was doubled from 400K baht to 800K baht.

 

But, importantly, those who were on a current extension were GRANDFATHERED and so could continue their application in the years that followed with just 400K.

 

The change of rules in the recent police order come into effect on 1 March. So a significant number of long term expats, many of whom have well established roots here with families and other commitments, must now scramble to find more money, or be torn from their loved ones.

 

And, importantly, they were given just one month's notice.

 

Why does the new police order not include any reference to grandfathering, and given expats have been given just one month to comply, is its current wording in breach of our international human rights?

 

Other members on Thai Visa have posted that rights groups have already sprung up in some areas. Apparently one is called "Don't take my husband". Can anyone confirm this?

 

Yes the requirements for visas are more onerous in many western countries.  But the rules are never changed for those on current permissions of stay. And financial requirements are never doubled with just one months notice.

Yeah, since when has Thailand worried itself about human rights? They have signed lots of treaties on the subject, but singularly fail to deliver. One quick look at the prison system here shows blatant and numerous breaches, which they simply deny, despite the evidence and continue to do what they like. Cambodians and Burmese are considered about the same as animals. Why would they care about us?

In a legal sense it's probably perfectly OK. Even if it wasn't what are you gonna do? Go to the UN? Retired expats are not considered displaced refugees even though in some cases there are some similarities.

 

You could contact CNN. Media might be interested in the human interest angle. If I were them I would be but I'm not them.

 

Not so much the technical issues of the visa changes but more about human interest part of lower budget westerners finding trouble in paradise in retiring abroad.

Where do you come up with the idea you have any human rights?  Just because you grace the world with your presence.  If you are a citizen of a country you have whatever "rights" that the government bestows on you.  Just because you exist does not give you the "right" to enter any country without its permission and following the rules that it prescribes.  It is certainly not a "human right" to be allowed into Thailand just because you want to be here.

As part of international human rights, you have a right to belong to a country, Thailand hasn't taken away your right to naturalize and become a Thai Citizen, this new extension rules does not take away any of your rights such as the right to a nationality and right to Move as you want within your own country or leave and return to your own country

I would like to see a waiver possibility for people who have resided in Thailand for many years and have an income of 250,000 to 300,000 per year.  I have friends in that situation who won't be able afford the 800,000 in the bank for five months and 400,000 for the remaining seven.  Fortunately some are EU citizens whose countries continue to issue income letters.

Sorry O/P but your argument falls flat on its face by simply reading your own comments.

 

You refer to the financial changes for a retirement extension, but you build your case around the potential affect on families. What's the connection I might ask?

 

The financial rules pertaining to a marriage extension have not changed at all, so your argument is, I'm afraid,  self defeating.
