NEW YORK (Reuters) - U.S. President Donald Trump is seeking the dismissal of a lawsuit claiming he defrauded his niece out of an inheritance worth tens of millions of dollars, accusing her of embracing "conspiracy theories" in her quest to consume him with lawsuits after he leaves the White House.

 

The president's lawyers said Mary Trump gave up her claims in a 2001 settlement with family members over the estate of his father Fred Trump Sr, who died in 1999.

 

They also said Mary Trump waited to long to accuse Donald Trump, his sister Maryanne Trump Barry and his late brother Robert Trump of trying to "squeeze" her out of her inheritance, relying instead on a 2018 New York Times report on tax matters involving the family.

 

"Plaintiff makes outlandish and incredulous accusations in her complaint, which is laden with conspiracy theories more befitting a Hollywood screenplay than a pleading in a legal action," the lawyers, who also represent Robert Trump's estate, said in a filing on Monday in a New York state court in Manhattan.

 

They said the lawsuit's "true purpose" was "to weaken the President's political influence during his post-presidency by preoccupying him with the defense of innumerable lawsuits."

 

Mary Trump, 55, a psychologist, made some of her allegations in her best-selling tell-all: "Too Much and Never Enough: How My Family Created the World's Most Dangerous Man."

 

The president's sister, a retired federal judge, also wants the lawsuit dismissed.

 

Roberta Kaplan, a lawyer for Mary Trump, said that while her client "is surely no fan of Donald Trump or his administration's policies, [the] intra-family fraud is what this case is about."

 

Donald Trump, a Republican, was defeated in the Nov. 3 election by Democrat Joe Biden and his term ends Jan. 20.

 

Trump faces several other legal actions. These include a criminal probe by Manhattan District Attorney Cyrus Vance, a civil probe by New York Attorney General Letitia James into whether he inflated asset values to obtain loans and tax benefits, and a defamation lawsuit by the writer E. Jean Carroll, whose allegation of rape he has denied.

What? He blasts! Seeks dismissal! I actually thought that the US president knew that an accused man must go to court and prove his innocense. After that let the jury or judge, depending on choice, present the outcome of the trial. It´s really sad to be so uneducated for a man in his position.

He should know that the UK (Yes Scotland still part of the UK) has an extradition treaty with the USA......maybe he should try Russia or Cuba instead

Through out his business life Trump has failed to pay companies and people who have done work for him.

With all the current and pending legal action pending is Trump paying the lawyers who represent him, his companies and family Any  smart legal firm would be asking for payment up front but as we have seen Trump does not appear to employ smart lawyers. eg. fraudulent election claims 60, 59 thrown out or withdrawn.

It would not matter how smart they are. That's why the more reputable lawyers ditched Trump as a client, for fear of damaging their own success story.

Trump had better hope Biden serves out his full term. IMO if Harris replaces him at any point, her first act would be to have Trump arrested and charged with sedition. She was Attorney General of California, and she knows where the jugular is.

It's not over until noon on the 20th.  There's a still a fear Trump will (try) to invoke martial law and somehow get the military involved.  It won't happen, but as usual, he can create huge problems trying this. 

 

He should be tried for sedition, along with his corrupt enablers.

He's not invoking anything because underneath he's always been a coward...he would hope someone would do his dirty work for him. Cowards ultimately slink away in the dead of night. I expect he'll disappear in the next week from the White House and hide his face in shame.

As this article says, it's not just Trump.  It's the entire GOP.  Look at what Lindsey Graham is doing!  He should be jailed.

I'd love to believe you, but we know Trump will spin this into a win.  He's potentially setting up a nutjob media outlet.  And for now, is leader of the GOP.  Go against him and you are toast politically.

Fred Trump saw the move as an attempt to go behind his back and removed his son from having sole control of the estate, The Times reported, citing depositions and other documents it obtained.

 

Fred Trump feared that his son would strip the estate to rescue his own failing empire, the report says.


The investigation by The Times found that Donald Trump and his family engaged in "instances of outright fraud" to enhance their wealth. New York agencies are investigating the allegations in the report.

Hmm.  "She gave up her claim..."   Why does that sound familiar?  Oh, yeah.  Sort of like Trump giving up his claim to live at Mar-A-Lago in order for it to be zoned commercial.   And, now he wants to go back on that.  No respect at all for the law.

Being an ex-president entitles him to Secret Service protection the rest of his life.  I don't know if any former pres has actually refused it.  He's going to have to  dismiss them because he won't be able to maneuver, and he will leave trails/records of wherever he goes and whoever he meets so long as he is in their charge.  Records are kept, info goes up the chain of command, info gets spread, etc and a prosecutor or three may take an interest in his current doings. 

The protectors may at some point be his captors.  Who knows, this may possibly happen on Jan. 20th.

Have you read why she gave up her claim?  It has to do with fraud on the part of Trump and his siblings.  I wish her luck!!

Seen some reporting that some cadre of SecServ have been deemd too loyal to trump to serve the next president.

 

I doubt he'd turn down free government service?
