So if there is damage to the roof in a storm will they pay for the repairs to the roof? Of course not, then it becomes communal property.

The roof space is clearly not part of the chanote so is not owned by the occupier. By definition it is common area and any building there must be illegal.

Condo buyers own the air space inside the walls of their unit & the contents including non bearing walls. 

The association in which an owner is a member,  owns the structure, the slabs, walls, beams, columns, common area.
