Simple story: guy in Surin with a huge overstay (11 years), helping him anytime he asked and i can, but after one year (oh help) he is still here and, apparently, doing nothing to try (even if is impossible) to sort out his problem or even try to back his country. I wrote here cause the only help he will get from me. from now, will be any possible solution to sort it out, or fly away; he knows about the ban, what he needs to fly out in terms of funds and paperwork? Any possibility he will detained at immigration in Bangkok airport?

Unless he has millions of Baht to grease many hands, his only option is to book a flight out of the country, check-in, go through security and hopefully be allowed to pay the overstay fine of B20,000 and accept a 10 year ban.   There were reports recently at Phuket Airport of overstayers being arrested before they got to Immigration, perhaps tipped-off by a check-in employee but I have never heard of that at BKK.

What your friend needs to realize is that he could face an indeterminate incarceration in an IDC if arrested and they are very unpleasant places.

Passport almost certainly run out so will need a travel document from his embassy, pay the 20k if he can make it to the airport without an arrest then get a very deserved 10 year ban. I despise these long time over stayers, they always have an excuse of course.

Yes, but then he is restricted to a non-stop flight to his homeland. Airlines won't allow a transit passenger with expired travel documents.

I get that. But he's been in Thailand long enough to remember when a 20k fine upon leaving allowed an overstayer to come back in the very next day.

 

I think the guy made a big mistake, but he's not affecting the quality of my life one iota. So I wish him well.

 

Probably hundreds of guys just like him, living quietly under the radar and not harming anyone, really. Just got caught up in a rule change.

The big issue is whether the guy has to travel to his embassy, exposing himself to the risk of getting caught. Plus the expenses involved and trying to find a hotel without travel documents upon check- in.

Few weeks over stay I can understand but 11 years is just taking the pee and sticking his finger up to Thai immigration laws, he has no respect for the country or it's laws. Anyone in his position should get a lifetime ban, 10 years is generous.

Wouldn't an expired passport...

 

1. Lead to refusal of the airline to let him board?

 

2. Refusal by Immigration to let him leave the country?

 

3. Consequently, his arrest?

 

 

He'd need a new passport.

When working in the UK in 2000, one of the workers told me he was illegally in the country for 12 years but he was employed and working for a British company and the management seemed to all know about him.

 

In my home country met many of the bolt drivers who are illegally in the country. They arrive and just never leave.

 

Govts cant track everyone and maybe some people are sympathetic or just ignore it, this happens in many countries and Thailand is not immune.

I doubt very much one can travel on an expired or no passport. I would think they would then be detained at the airport. Best get the pp renewed or get an emergency travel document from the home countries embassy/consulate.

Just to be clear, that's much different then just making a run for it and wanting to fly out with nothing. He would have substitute documentation, even if it was not technically a passport.

 

Now, at least for the USA, if you just show up at the border and claim citizenship I'm sure you can get in, even if you have to claim asylum. They just detain you until your citizenship is verified. Like a social security number, drivers license, passport record, whatever, but you have to make it to the border somehow. Everything is cross checked including pictures and fingerprints.

 

One option would be to hire passage on a sea vessel via the black market or hire a boat (or even buy a vessel) and just take off. Then proclaim citizenship when intercepted by the coast guard in home country waters.

After 11 years he may as well just continue to fly under the radar as long as he can get away with it, the penalties aren't going to get any bigger. Unless he has a wish to return home, then that's a different story.

Only if he doesn't have 20,000 THB on his person in crisp 1,000 THB notes to hand over to them at Departures. He would be at considerably greater risk of detention if he were stopped at a police check-point en route from Surin to BKK, I think.

It will certainly be possible for him to be admitted back into his home country on the basis of an expired passport. But whether his chosen airline will allow him to fly there on 1 of their flights in the absence of suitable alternative ID in the form of an emergency travel document could, I think, be another matter altogether.
