HI,

I'VE BEEN WITH MY GIRLFRIEND FOR OVER 2 1/2 YEARS NOW WITH ME VISITING 10 TIMES IN 2 YEARS.

MY GIRLFRIEND GOT HER FIRST UK VISA QUITE EASILY AFTER US SUPPLYING WHAT THE VISA PEOPLE REQUIRED + A LOT MORE . LOADS OF PHOTO'S & PAPERWORK ETC.

MY QUESTION IS WE ARE GOING FOR ANOTHER HOLIDAY VISA AFTER SHE RETURNS IN NOVEMBER. WHAT MORE DO WE NEED TO SUPPLY . AS SHE HAS STAYED FOR THE FULL 6 MONTHS SHE NO LONGER HAS A JOB TO RETURN TO (WE PUT ON THE VISA & TOLD HER BOSS THAT SHE WOULD ONLY BE VISITING FOR 1-2 MONTHS BUT AS THINGS SEEM TO BE GREAT WE WANT TO STAY TOGETHER HERE FOR THE FULL 6 MONTHS).

DOES SHE HAVE TO WAIT FOR 3 MONTHS BEFORE SHE REAPPLIES.

SHE HAS A FAMILY IN TRANG WHICH SHE WILL BE RETURNING TO WHILST THE VISA IS SORTED OUT.

PLEASE GIVE US ANY INFO THAT MAY HELP IN THE SECOND APPLICATION.

It is not expected that a visitor will spend more than 6 months in any 12 month period in the UK, otherwise she is effectively living there so you will unlikely be considered if she doesn't at least remain in Thailand for 6 months.

You have to provide exactly the same as you provided last time . She will still have to provide a compelling reason to return to Thailand and without a job you'd better start thinking. If she finds a job do you think the ECO will believe any letter written by any employer after she didn't stick to her word about length of stay this time.

I think you may have blown your chance, things might not seem so great from now on!

I think the best plan of action might be to (sadly) send her back now, if she stays the full length, and then applies straight away, you will possibly scupper your chances in the future.

SURELY IF SHE GOES BACK WITHIN THE 6 MONTH PERIOD SHE ISN'T DOING ANYTHING WRONG. THE REASONS ARE GOOD ENOUGH TO STAY HERE FOR SO LONG MY BROTHER HAD HIS 40TH BIRTHDAY & MY MUM WILL BE CELEBRATING HER 70TH BIRTHDAY & SHE CAME OVER TO THAILAND LAST SUMMER TO HAVE A HOLIDAY WITH US. SO SHE WANTS HER THERE TO CELEBRATE HER BIRTHDAY. ALSO THERE IS MY NIECES WHO WILL BE 21 & 25 BOTH ARE HAVING PARTIES & MY BROTHER IN LAW WHO WILL BE 50

PS ALSO WE HAVE JUST BEEN DOWN TO LONDON TO VISIT OUR FRIEND'S WEDDING THE BRIDE IS HER FRIEND FROM THAILAND. SO WE HAVE HAD & WILL HAVE PLENTY OF EXCUSES WHY SHE HAS STAYED LONGER WITH PHOTO EVIDENCE.

Legally she is doing nothing wrong if she returns to Thailand within 6months of the date of issue of the visa.

It's not excuses the ECO wants it's evidence that your girlfriend sticks to her word and she is not doing that. Birthdays did not change, they were the same dates when she applied for the visa, they didn't just suddenly occur while she was on holiday! She could have planned for them and given them as a reason for her visit but she didn't.

Also she will not be given a visitors visa if it looks like she is using it to live in UK. She will unlikely be considered if she expects to spend more than 6 months in any 12 months in UK and as previously said she will still have to give a credible reason to return on the second occasion.

She can apply for a Fiancee visa but she will have to show evidence that the wedding is arranged on applying for the visa and you will have to marry within 6 months otherwise she will have to return to Thailand.

The issue here is not necessarily that your g/f will have stayed six months, but that she said she would stay only 1-2 months, and, as a consequence of staying the six, has now lost her job. Both her credibility and incentive to return to Thailand are now shot to bits and she will find it difficult to get another visit visa at all, let alone in a matter of months.

AECIP 83/03 states :

"A reminder has now issued to all our offices overseas (under reference AECIP 83/03). The relevant section of this AECIP reads as follows:

"1. There has been some confusion over whether ECOs [Entry Clearance Officers] should be asking for confirmation of wedding bookings at a registry office. This should not be happening. Registrars cannot make arrangements until the foreign national has arrived in the UK.

"2. ECMs [Managers] are therefore asked to re-acquaint themselves and their staff with the procedures outlined in DSP 13.9".
