It's not a new indictment but a "superseding" indictment of the original indictment recommended by a new grand jury. 

Trump's guilt or innocence will be determined by a jury, not DOJ, POTUS Biden or Jack Smith.

The 34 charges were “stepped up” from misdemeanors to class E felonies because prosecutors said the crimes were carried out in an effort to commit or conceal another crime – these crimes being election conspiracy and campaign finance and tax law violations, (hardly politically motivated).
Whilst it is unlikely that Trump would face incarceration, each charge carries a possible 4 year prison term.
