Trump asks Supreme Court to halt sentencing in New York hush money case

WASHINGTON/NEW YORK Jan 8 (Reuters) - President-elect Donald Trump has asked the U.S. Supreme Court to prevent a New York state court from sentencing him for his conviction on criminal charges stemming from hush money paid to a porn star.


"This court should enter an immediate stay of further proceedings in the New York trial court to prevent grave injustice and harm to the institution of the presidency and the operations of the federal government," his lawyers wrote in a filing made public on Wednesday.

 

On Tuesday, a New York appeals court denied his effort to halt sentencing scheduled for Friday in New York state court in Manhattan. In Wednesday's filing, his lawyers asked the U.S. Supreme Court to immediately order a stay in the case, as he seeks an appeal to resolve questions of presidential immunity.


They said they had simultaneously asked the state's highest court for the same emergency relief.

This will be an interesting test of just how far this supreme court will bend over to serve master Trump.

Biden broke his promise not to use his constitutional pardoning power for his son.

That did expose him to at least one undeniable lie, but on the other hand, most human beings do understand that most any father would use such power if they had it, and he had it.

Merchan’s concern for the rule of law and his condemnation of Trump’s attack on the judiciary are well stated. But his timing puts higher courts in an impossible bind and his ruling is not likely to be well received by a Supreme Court especially protective of presidential power. (my bold)

His timing? As requested by trump after the election, and would have to be before the inauguration. I don't see much margin there.

If Trump asks, there’s a good chance that an appeals court, and maybe even the United States Supreme Court, will delay the sentencing, effectively until after his presidency. To begin with, Merchan had months and months to decide to sentence Trump. By waiting until the last minute, he’s putting all the courts in a bind.

Sentencing will progress today, his appeal to me SC eas rejected.

This sentencing is merely a formality and he knows it. We all know the only reason he wanted this halted was so he wouldn't have the actual legal label of convicted felon when he lies during the oath of office. In New York, you are technically not given that label until sentenced. That still won't stop him from backing up the truck to the White House and looting it for all it's worth.
