US court blocks Trump's sweeping tariffs, citing overreach of authority

NEW YORK, May 28 (Reuters) - A U.S. federal court on Wednesday blocked President Donald Trump's "Liberation Day" tariffs from going into effect, ruling that the president overstepped his authority by imposing across-the-board duties on imports from nations that sell more to the United States than they buy.
The Manhattan-based Court of International Trade said the U.S. Constitution gives the U.S. Congress exclusive powers to regulate commerce with other countries that are not trumped by the president's emergency powers to safeguard the U.S. economy.

The lawsuit, filed by the nonpartisan Liberty Justice Center on behalf of five small U.S. businesses that import goods from countries targeted by the duties, was the first major legal challenge to Trump's tariffs.

The companies - which range from a New York wine and spirits importer to a Virginia-based maker of educational kits and musical instruments - have said the tariffs will hurt their ability to do business.

The lawsuit is one of seven court challenges to Trump's tariff policies, along with challenges from 13 U.S. states and other groups of small businesses.

Actually this is a perfect example of one branch of US Government holding the other in check.

 

Do you know how US government works? Three branches were setup by founding fathers to hold each other in check.

 

This is the US government working as it should and holding a cowboy loose cannon of a President in check.

As the court rules are set not to elect too many of one party or another, there is balance.

Anyone who does not believe in the Constitution or the law can explain why they are wrong.

Trump's team of government disrupters may be turning into a team self-disrupters.

One of the cases joined in the court ruling today was originally filed in Federal Court Pensacola, FL. Team Trump filed to have it moved the NY CIT panel that ruled today.

Based upon the order granted by the judge in FL -- a Trump first term appointee -- he might have been better off leaving the case in Florida.

Most can be fairly certain God is the last thing on this man's mind. If God were, he would be saying and doing things quite differently.

Everyone can tell by the way this man talks and acts that he knows no God nor act's much like anyone who has a God in their life.

We can only pray that he might actually come to know God and start living by spiritual principles rather than the superficial satisfaction of his need for Power, Social Recognition, Sex, Money and the like. It's quite obvious this man has serving himself in the front of his agenda. Not serving God.

This is from the Florida ruling granting Team Trump's as Defendants case transfer to the CIT in NY:

 

This is a civil action commenced against the United States and it “arises out of” a federal law—IEEPA—so the dispositive question framed by the parties’ filings is whether IEEPA “provid[es] for … tariffs.” Defendants contend that it does; Plaintiffs contend that it doesn’t. The Court agrees with Defendants for the reasons that follow.

 

The CIT ruling today pretty much says the opposite.

 

So maybe 'own goal' time for Team Trump?

Anything that anyone can do to stop this maniac from continuing to erode American influence, and to shake him out of his neurotic delusion of returning manufacturing back to the US is a good thing.
