Leaving a condo in my will to my kids, non Thai.

I'm a Falang on Non 0 visa. 

When you buy a Condo, you have to show the money came from out of the country. Fair enough.

If you sell to a Falang, they will also have to show the money came from out of the country. Normal.

If you sell to a Thai, they don't have to show the money came from out of the country. Normal.

 

But if I leave the condo to my kids, for them to get their name as owner in the Property Registry, they have to show they imported the money too.

Again.

They’d have to import the registered value of the condo to get the condo for free.

That’s what I’ve been told. Is that true?

Sorry about that. I didn't see the Property, Finance forum.

My kids are from 39 - 29, not in Thailand.

If i'd known they'd have to pony up cash, I probably wouldn't have bought. 

Plus if they're under presure to sell or register within 12 months, or get a lawayer to get an extension. 

My bad, oh well, luckily I bought a cheap condo. 🙂

you need to check into it as it may not be exactly as you're thinking. They would have to pay the transfer tax but they arent buying the condo so there shouldnt be any large sums involved.. You could always transfer to them before you die, which may be a better option. Im not sure of the mechanics involved. 

Leave your condo to a poor Thai, it will change their life. For your adult children living in the west, your cheap condo would probably be more of a nuisance than anything else.

Right? The cost and fuss of getting any cash out, and if they succeed, dividing what's left by 4 western kids is barely worth it. 

The law is clear, farang inherit condo? Then: the value, as estimated by the land department, needs to be transferred into Thailand from overseas. No exceptions.

Annoying, especially if in the farangs country a Thai has the freedom to sell/buy any real estate as they please. 

 

Maybe, but just maybe, the idea to give it to some Thai as a donation might be good. But, as careless as most Thai owners treat their properties I would not feel comfortable giving it away just like that...

Are you sure this is right? There would be no cash changing hands so why would the value need to be transferred into Thailand? What about if it was just sold by the beneficiaries and provided the transfer taxes paid the cash is transferred out of Thailand?

Right. My wife and I bought a condo in joint names. Later on we agreed to transfer it soley into my name with no money changing hands. It was treated in effect as a new purchase. I had to bring in the estimated value into Thailand again even though i had already done it once.

I don't know if this would work for you. Only a suggestion. It likely depends on your age.

 

Sell the apartment, rent another, and live on the proceeds from the sale for as long as possible. While living on those proceeds, don't bring any more money into the country. Leave it in a UK bank. That way, you can make a UK will for them to get your assets.

They can file for a one year extension to find a buyer, but still...

Make a donation to them BEFORE you die. Maybe add a usufruct agreement to you. That will save trouble when you pass. That's what I did with ThaiLaw Online. Safe, easy. DIdn't cost most.
