    Even when you don't marry a hooker, you often get the same result in Thailand.   Believe me, I know. Thai parenting is often quite bad to say the least, by Western standards.

For start, even if your name as a father stands on the birth certificate, does not make you a legal father or guardian in Thailand. The mother has all the custodian rights for birth automatically.

 

The base case under Thai family law is that, if the father is recognized as the father, which is automatically the case, if the parents were legally married at the time of birth, both parents have equal custodianship.  If there is a divorce and custodianship is disputed, the family court will award custodianship and visitation rights using the best interests of the child.  The OP says the father is an ex-husband but doesn't say if they were actually legally married or divorced and, if so who had custody. 

 

Thai courts prefer to give custody to the mother, if they can, but will not do this, if it does not appear to them to be in the best interests of the child.  I have a friend who divorced a Thai wife from hell - prostitution, drugs, booze, gambling, toy boys  and child abuse, you name it.  The court awarded sole custody to the farang father without rights of visitation for the Thai mother.

This is not totally true. If they were married, and stayed married, and the child was born,  and he is the father. Thai law or any law, he has full rights like the mother.  

I know, I when through this in a Thai court.

In addition, according to "Thai law", any parent without the other consent can take that child.

If the other parent wants custody, either joint, shared, or full custody that parent has to go to court and the court will decide. 

If he is the father, married and that child was born, he knows Thai law.

My best advise is to get all the evidence on the Thai mother, being not fit to be is mother. When all are correct, take her to court to get full custody so his child. That way he can take the child out of Thailand anytime without the mother consent.

But be warned, she will put up a fight with the appeal court.  But an appeal in Thailand is no big thing, one do not have to attend court, they just made a decision, and the person that bring the appeal has to pay the appeal court.

I am not the one who made assumptions. You did. The person I responded to has assumed that the man's story was accurate. I have only pointed out the  reality of a custody dispute.

The father's alleged association with drugs is irrelevant, same as the earlier allegation about the mother's HIV infection.

Yes I have, and most 18 year olds don't. Some do several times but most do not.

 there are lot of guys who like to brag about how they never use condoms and even pay a girl more not to use one....how does that work out with dear ole dad  when the gal gets pregnant and dear ole dad doesn't care.

I have a US acquaintance,lived in Pattaya many years. He has a 12 year old son, mother still works in a bay which mainly has loud ignorant gatoey staff. The mother of the by is as described just above very loud and ignorant and has brought the 12 y o boy to the bar many times. i'm told this always turns into a party with the other gatoey all putting their hands inside the boys shorts/ underwear and groping him. Seems that many of the gatoey hold the boys arms and body so he can't defend himself.

The boys real father has tried several times to get full legal care of the boy along with court order that his mother cannot be near him. None of this has worked.

The boys real father is now in the process of trying to get a Thai court order which could be the needed back up to get avisa for the boy to enter the US.  Seems that it's all in process right now.

Fair call. My little village, (maybe 1,000) population, fits this observation. Anywhere from 14+.🙃🙃

One is alone and miserable. One died from a heart attack brought on by doctor over prescribing, and this last one is married and still wants to be back with me. Might want to update those files. 

Thailand is not a party to the Hague Treaty. The case is almost closed.
