This has most likely been asked before but I would be grateful for clarification. My question is ...

Is it possible to live in Thailand on a retirement visa and trade in stock shares foreign exchange via the internet outside Thailand. Do you need a work permit

  • You can't get a work permit.
  • You need permission to legally work in Thailand.
  • If trading is your occupation/job then you need permission, which you can't get.

As it stands the authorities seem to tolerate remote work like this so the best advice is to do your trading in private and enjoy your retirement.

OP, if you are trading stocks in foreign exchanges as your own investment portfolio, then it wouldn't seem to be a problem. That's not "working" or a "job".

If it's an occupation, then technically you'd need a work permit but as elviajero implied it's in a bit of a gray area.

(It's unclear to me from the OP whether he means trading stocks as an individual investor or as an occupation.)

No money flow in/out of Thailand from this business.

No business (relations) within Thailand.

If you are anxious use a VPN based in your home country for all internet transactions.

Don't brag about your success at the farang stone-table.

Just keep all the trading and banking related to the trading outside of Thailand.

It's not something you would want to announce at immigration though.

Managing your own assets does not require a work permit.

Thailand has stated that 'owning stocks' is fine and doesnt need a work permit..

Thailand has never (to my knowledge and I have looked) said 'trading stocks' short term is ok.. But defining a difference is near impossible.

Secondly to that topic using margin, hence not 'owning stocks' but borrowing on stocks, so they are not technically 'yours'..

Despite multiple requests no one will ever go on record and explain why gambling is illegal but futures trading (betting on the future price movement) is not illegal.. If you ask about 'spread betting' your usually told its gambling, yet it is near identical to futures trading...

The whole law around this is as usual vague and ill thought through.

There are some trading houses who buy physical server space in the same building where the exchanges house their servers because, with some types of trades, the advantage gained in milliseconds can determine the outcome of a trade. I guess the Thai officials figure if you're going to try to compete with those types traders from somewhere in Thailand, they ain't gonna worry about it.
